WHEREAS, the Board of Directors of the City of Little Rock endorsed the development plans for the River Market District and River Market in Little Rock, Ark., Resolution No. 9,476 (September 5, 1995); and WHEREAS, a crucial aspect of the River Market District is the creation of a mixed office, commercial, residential land use area that promotes and encourages pedestrian traffic; and WHEREAS, the City has received bids for the River Market District East Markham Streetscape Project construction, and staff recommends that the low bid submitted by Township Builders, Inc., in the amount of $1,204,120 be accepted with a deduction for the decorative crosswalks; and WHEREAS, additional funds are needed to complete the River Market District East Markham Streetscape Project as set out in this bid; and WHEREAS, Township Builders will deduct the cost of decorative crosswalks from the contract amount, therefore decreasing the amount by $192,000 and leaving a contract balance of $1,012,120; and WHEREAS, this deduction is less than twenty percent (20 %) of the entire contract amount and since there are no other bids, an equivalent deduction would not result in another company being awarded the bid; and WHEREAS, it is in the City's best interest to have this streetscape completed at one time in order to assure conformity within the District; and 471 • 472 1 WHEREAS, a funding mechanism has been developed where 2 property owners affected by this construction will pay a 3 definite sum per square foot. 4 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 5 THE CITY OF LITTLE ROCK, ARKANSAS: 6 7 SECTION 1. The City Manager is authorized to accept a bid and award a contract for the River Market District East Markham 8 9 Streetscape Project to Township Builders in an amount not to exceed one million twelve thousand one hundred and twenty 10 dollars ($1,012,120), understanding that such contract does not 11 include work on decorative crosswalks set out in the bid 12 documents. 13 SECTION 2. Funds available for the project are as follows: 14 (a) There is hereby appropriated the sum of 15 $325,000 from account number 212 -8500, 16 the Economic Development Fund, to account 17 number 210 - 230 -0418, the East Markham 18 Streetscape Project. 19 (b) There is hereby appropriated $330,120 20 from account number 100 -8502; the 21 Designated Contingency Account, to the 22 East Markham Streetscape Project, account 23 number 210- 230 -0418. 24 (c) Additional funds to complete the funding 25 required for the project are as follows: 26 $157,000 from private donations by 27 property owners have been pledged; 28 $200,000 in revenues will be received 29 through the Trees for Tomorrow Special 30 Project, account number 210 - 230 -0477. 31 SECTION 3. DECLARING AN EMERGENCY. The City has previously declared that the development of the River Market District is essential to the revitalization of downtown Little Rock and will help to promote the public health, safety and welfare. It is essential that any development that is so dependent upon pedestrian traffic for its success have in place adequate curb and gutter, sidewalks, and streetlights to assure the public safety of the patrons living in, working in, or shopping in the market. Since construction in this area, even if it were to begin immediately, could not be completed for at least six months, it is particularly important to get street lighting and sidewalks in place as soon as possible before seasonal changes result in early darkness which makes it difficult for motor traffic to see pedestrians in the area. Because the River Market Building has opened for business, and to assure that all improvements are in place for other businesses that may open, as well as the improvements to the Central Arkansas Library.System and the Statehouse Convention Center, an emergency is declared to exist and this ordinance shall be in full force and effect from and after the date of its adoption.
