17215I ORDINANCE NO. 17,215 2 3 AN ORDINANCE AMENDING LITTLE ROCK 4 ORDINANCE NO. 15,854• TO REVISE 5 CONTROLS OVER THE USE OF ABOVEGROUND 6 STORAGE TANKS FOR FLAMMABLE AND COMBUSTIBLE LIQUIDS AND LIQUEFIED 7 PETROLEUM GASES; DECLARING AN 8 EMERGENCY AND FOR OTHER PURPOSES. 9 10 WHEREAS, on April 17, 1990, the Little Rock Board of 11 Directors adopted Little Rock, Ark. Ordinance (:LRO") No. 15,854 establishing controls related to the use of aboveground 12 storage tanks for flammable liquids and liquefied petroleum 13 gases; and 14 WHEREAS, the Board of Directors of the City of Little Rock, 15 Arkansas has determined that the storage of flammable and 16 combustible liquids in aboveground tanks shall be regulated so as to not present a hazard to life and property; and 17 WHEREAS, technological advances in the design and 18 construction of aboveground liquid fuel storage tanks have been 19 made since the City code provisions now regulating such tanks 20 were adopted; and WHEREAS, thorough testing of such technologically advanced 21 storage tanks has been accomplished by Underwriters' Laboratory 22 ("U.L. "); and 23 WHEREAS, revision of the existing City code provisions 24 regulating aboveground liquid fuel storage tanks is necessary to 25 accommodate the technological advances made in such tanks. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 SECTION 1. Little Rock, Ark. Ordinance No. 15,854 is hereby 28 amended to be read in its entirety and to be placed in Chapter 29 12 beginning at Section 12 -5 as follows: 30 Sec. 12 -5. Aboveground storage tanks for flammable liquids, liquefied petroleum gases. 31 (a) It shall be unlawful for any person to store Class I or 32 Class II flammable and combustible liquids, as defined by the 33 Arkansas Fire Prevention Code, inside any recognized fire 34 district in aboveground storage tanks. These tanks may, however, 35 be installed in other sections of the City in conjunction with National Fire Protection Association ( "N.F.P.A. ") Pamphlet No. 36 30, entitled "Flammable & Combustible Liquids Code," and • • 376 1 thorough review and approval by the chief of the fire department 2 or his designated representative. The chief of the fire 3 department or his designated representative shall have authority 4 to cause the removal of any storage tanks not in compliance with 5 said standards upon determination that the tank creates a safety 6 hazard to life or property. (b) The storage of liquefied petroleum gases in aboveground 7 tanks is prohibited in any of the designated fire districts of 8 the City of Little Rock, with the exception of tanks existing 9 upon the passage of this ordinance and which are installed in 10 compliance with the requirements of the Arkansas Fire Prevention 11 Code and the state code on liquefied petroleum gas containers and equipment. The chief of the' fire department or his 12 designated representative shall have the authority to cause the 13 removal of any.liquefied petroleum gas storage tank that does 14 not comply with the referenced standards upon determination that 15 the tank creates a safety hazard to life or property. (c) Nothing in this ordinance shall prohibit the use of 16 Class I or Class II liquids in outside aboveground tanks having 17 capacities of less than six hundred gallons when used on a 18 temporary basis for up to two years in conjunction with a 19 construction project. 20 (d) Nothing in this ordinance shall prohibit the storage of fuels for farm, factory or industrial use or fleet servicing of 21 private vehicles if the tank is of double wall steel or double 22 wall steel and concrete construction displaying the 23 Underwriters' Laboratory ("U.L.0) seal of approval. . 24 (1) Safety requirements. 25 a. Such tanks shall have overfill alarm protection. b. Signs stating Ono smoking within 500 feet" with 26 lettering of not less than four inches in height shall 27 be placed on all four sides of the tanks so as to be 28 clearly visible to persons in the area. 29 C. Steel bollards to protect the sides of the tank shall 30 be installed at intervals of no more than six feet in length all around the tank, using pipe of not less 31 than six inches in diameter, buried not less than four 32 feet deep in concrete with a five -foot aboveground 33 height. 34 d. A portable fire extinguisher with not less than a 35 ten -pound B -C rating shall be placed by each tank and fuel dispensing area. 36 e. Pamphlet No. 30. Care shall be given to assessing the compatibility 'of each location with existing structures or other hazards. Without exception, all single wall steel or other type aboveground liquid fuel tanks containing Class I or Class II fuels shall be located a minimum of 150 feet from a common property line and shall be installed according to N._F.P.A. Pamphlet No. 30. (e) PENALTY FOR VIOLATION. Any person convicted of a violation of any provision of this ordinance shall be punished as provided in Section 1 -9 of the Code of ordinances. (f) DECLARING AN EMERGENCY. An emergency is hereby declared to exist and this ordinance, being necessary for the preservation of the public health, safety and welfare, shall take effect and be enforced from and after the date of its passage.
