5 AN ORDINANCE TO AMEND LITTLE ROCK, ARK.,
6 ORDINANCE 17,065 (DECEMBER 26, 1995) TO
7 PROVIDE FOR A FILING FEE FOR REZONING
8 REQUESTS FOR C -4 ZONING CLASSIFICATIONS;
9 DECLARING AN EMERGENCY AND FOR OTHER
PURPOSES.

11 WHEREAS, the.Board of Directors adopted Little.Rock, Ark.
12 Ordinance 17,065 (December 26, 1995) to establish uniform filing
13 fees for rezoning requests in subdivision applications; and
14 WHEREAS, the basis for this ordinance was the significant
cost involved in the evaluation of these requests, the cost of
15 publishing necessary notices, and the cost of making sufficient
16 copies for the public, the relevant commissions and the staff;
17 and
18 WHEREAS, by inadvertence a classification for C -4 zoning
classifications was omitted.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
20 THE CITY OF LITTLE ROCK, ARKANSAS.
21 Section 1. Little Rock, Ark. Code § 23 -3(a) is hereby
22 amended to read as follows:
23 (a) Rezoning. The filing fees for submitting to the city
department designated by the City Manager, rezoning applications
24 shall be as follows:

and mixed rezoning shall be determined by totaling up charges
for individual parcels according to the above schedule.
Section 2. Repealer all provisions of Little Rock, Ark.
Rev. § Code 23 -3 (1988) inconsistent with this ordinance are
hereby repealed to the extent of such inconsistency.
Section 3. A severance clause.
Section 4. Emergency. The ability to properly and timely
handle rezoning requests is essential to the pubic, health,
safety and welfare, and the ability to fund the review of such
requests also is essential to the public, health safety and
welfare. The fact that a rezoning oversight has occurred needs
to be immediately corrected so that appropriate filing fees can
be assessed for persons wishing to seek a C -4 rezoning request.
An emergency is therefore declared to exist and this ordinance
shall be in full force and effect from and after the date of its
adoption.
