17051M M M M M M M M M M M i M M M 0 0 591 1 2 ORDINANCE No. 17,051 3 4 AN ORDINANCE TO APPROPRIATE $14,800 TO PAY FOR A CONTRACT TO SECURE AND 5 PROTECT THE KRAMER SCHOOL BUILDING 6 FROM FURTHER DETERIORATION; 7 DECLARING IT UNFEASIBLE AND 8 IMPRACTICAL TO BID FOR SUCH 9 SERVICES; AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT 10 WITH ROBERTS AND COMPANY, INC. TO 11 PERFORM THESE SERVICES; DECLARING. 12 AN EMERGENCY; AND FOR OTHER 13 PURPOSES. 14 WHEREAS, the City of Little Rock is involved in several 15 causes of action concerning Kramer School and attempts to 16 demolish it; and ` 17 WHEREAS, the City has authorized the exercise of eminent 18 domain to acquire and preserve Kramer School; and WHEREAS, in settlement of this condemnation action and 19 other claims that have been filed concerning Kramer School the 20 City will ultimately take title to the school and then deed it 21 over to Historic Investments Solutions Team (HIST) to construct 22 apartments, an auditorium and exhibition space for low to 23 moderate income artists; and WHEREAS, it is vital that further deterioration of the 24 school building be abated, but there is no time to properly bid 25 for such services since winter is fast approaching; and 26 WHEREAS, a contractor has already been hired to review the 27 situation and make a binding estimate to protect the structure 28 from further deterioratioin; and WHEREAS, it is in the best interest of the health, safety 29 and welfare of our citizens that the contract be awarded to 30 Roberts and Company, Inc. 31 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 32 THE CITY OF LITTLE ROCK, ARKANSAS: 33 Section 1. The City Manager is authorized to enter into a contract with Roberts and Company, Inc., 2701 W. 7th Street, 34 Little Rock, Arkansas, in an amount not to exceed fourteen 35 thousand eight hundred dollars ($14,800.00) to secure the Kramer 36 School structure from further damage from the elements. The circumstances surrounding the settlement of various litigation matters concerning the school make it impractical and unfeasible to bid for these contractor services before the winter weather causes further deterioration, therefore, the requirement of competitive bidding for this contract is waived. Section 3. The sums for this contract are to be taken from Account No. 210 - 040 -0370. Section 4. Emergency. The winter weather, rains, frost, snows, and other harsh weather associated with winter will cause further irreparable damage to the Kramer School and could make it impossible to rehabilitate the structure. The need to issue a contract to prepare the structure for the winter is critical if this building is to be historically preserved in the best public health, safety and welfare interests of the City. An emergency is therefore declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
