ORDINANCE NO. 17,048
A ORDINANCE APPOINTING A SUBSTITUTE
COMMISSIONER OF MABELVALE- ALEXANDER SEWER
IMPROVEMENT DISTRICT NO. 142 OF LITTLE ROCK,
ARKANSAS; AND OTHER MATTER RELATING THERETO;
AND DECLARING AN EMERGENCY.
WHEREAS, the Mabelvale- Alexander Sewer Improvement District
No. 142 of the City of Little Rock, Arkansas (the "District ") is a
municipal improvement district duly created by the City of Little
Rock, Arkansas, and validly existing under the laws of the State of
Arkansas; and
WHEREAS, a former commissioner of the District, the same being
Everett Rowland, no longer qualifies as Commissioner by virtue of
no longer being a property owner in the District; and
WHEREAS, the Board of Directors of the City of Little Rock,
Arkansas, desires to appoint a replacement Commissioner to the
Board of Commissioners to carry on the affairs of the District;
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of
the City of Little Rock, Arkansas:
SECTION 1: That Ronald R. Pierce being a property owner in
the District and known to be of good standing in the City, is
hereby appointed to the Board of Commissioners of the District from
the date of this Ordinance, pursuant to the provisions of Ark. Code
Ann. § 14- 88- 304(b).
SECTION 2: That the person named in the preceding paragraph
shall qualify by taking his oath as a Commissioner of the District,
and shall file the same, all in accordance with the laws of the
State of Arkansas.
SECTION 3: That it is hereby ascertained and declared that
there is an immediate need for the vacancy on the Board of
Commissioners of the District to be filled in order to profect the
health, safety and welfare of the District, the City and its
inhabitants. It is, therefore declared that an emergency exists
and this Ordinance being necessary for the immediate preservation
of the public peace, health and safety shall be in force and take
effect immediately from and after its passage.
