FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. § 19 -11 -801 to -805 (Michie Repl.
1994), as may be amended, mandates that municipalities contract
with certain listed professional services on a competitive
selection process, but forbids the use of a price based
competitive bid process; and
WHEREAS, by virtue of Act 429 of 1995, the General Assembly
has granted municipalities the additional authority to declare
certain professions to be professional services to be chosen by
a competitive selection process, and
WHEREAS, for certain services, such as accounting services,
this declaration on an ongoing basis is appropriate, but for
other services, such as specialized consulting services, this
declaration should be of limited duration and exercised on a
case by case basis, and.
WHEREAS, Little Rock, Ark., Rev. Code $ 2 -243 (1988), the
City's professional services selection ordinance, should be
amended to conform with the Arkansas Code, to reflect the City's
desire to declare certain professional services to be considered
on a more permanent basis, and to set out a procedure for the
declaration of professional services on a case by case basis.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS;
SECTION 1. Little Rock, Ark., Rev. Code $ 2 -243 (a) (1988)
is hereby amended to read as follows:
(a) The city and all its boards, commissions and
authorities not otherwise authorized to do so by state law,
shall competitively select based on qualifications and other
relevant evaluation criteria other than price or cost:
(1) As required by the Arkansas Code, all architectural,
engineering, legal, land surveying services done for
or on behalf of the city;

(2) All services declared to be a professional service
if done for or on behalf of the City, its boards,
commissions or authorities, including the following:
accounting services.
(3) Any other appropriate service that the Board may
from time to time declare to be a professional
service because cost or price bidding, is found to
be impractical, unfeasible, or, if based solely upon
price, would result in an outcome that would not
meet the best interests of the City.
