AN ORDINANCE VACATING A PORTION OF THE PLAT OF
FAIRVIEW ADDITION TO THE CITY OF LITTLE ROCK
AND CLOSING THE RIGHTS -OF -WAY OF CENTRAL
AVENUE, OUACHITA AVENUE, PORTIONS OF THE
RIGHT -OF -WAY OF FLORENCE AVENUE AND FAIRVIEW
AVENUE AND CLOSING PORTIONS OF THE RIGHT -OF-
WAY OF CENTER STREET, SPRING STREET, AND ALL
OF THE RIGHT -OF -WAY OF BROADWAY STREET AND
ARCH STREET IN FAIRVIEW ADDITION, ALL IN THE
PLAT OF FAIRVIEW ADDITION TO THE CITY OF
LITTLE ROCK.
WHEREAS, the current owner of Blocks 1, 3, 4, 5, 6, 7, 8, 9,
10, 13, 14, 15, and 16, and portions of Block 2 and of Block 12 of
Fairview Addition to the City of Little Rock, the Plat of which is
recorded in Plat Book No. 1, page No. 121, has made application for
the vacation of portions of said blocks for the purpose of reducing
platted land to acreage, pursuant to Little Rock City Code X31 -11
(1988) and Arkansas Code Annotated §14- 301 -302; and
WHEREAS, the owner has not sold any of the lots within the
described area and it is the sole owner of the area to be reduced
to acreage; and
WHEREAS, none of the dedicated streets and alleys within the
described area have been constructed; and
WHEREAS, the streets and alleys to be vacated have not
actually been used by the public as streets and alleys for a period
greatly in excess of five years nor by any utility, except Arkansas
Louisiana Gas Company under a right -of -way agreement hereinafter
described, nor by the City of Little Rock.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Board of Directors of the City of Little Rock,
Arkansas, hereby approves the vacation of portions of the plat of
Fairview Addition to the City of Little Rock described herein,
together with the divesting of the public rights in the streets and
alleys included in the legal description of the portion to be
vacated, described as follows:
Part of the SE 1/4 of Section 22, Township 1 North, Range 12
West, Pulaski County, Arkansas, including Block 1, part of
Block 2, Blocks 3, 4, 5, 6, 7, 8, 9, 10, part of Block 12, and
Blocks 13, 14, 15, and 16 of Fairview Addition to the City of
Little Rock as shown in Plat of record in Plat Book 1 at page
121, more particularly described as follows, to -wit:
Beginning at a point that is 10 feet south of and 20 feet west
of the northeast corner of the NW 1/4 of the SE 1/4 of said
Section 22, thence southerly on a line that is 20 feet west of
the east line of the East 1/2 of the SE 1/4 of said Section
22, a distance of 1,680 feet, thence west a distance of 1,245
feet to a point on the west line of the NW 1/4 of the SE 1/4
of said Section 22, thence north along said west line a
distance of 320 feet to the southwest corner of the NW 1/4 of
the SE 1/4 of said Section 22, thence east a distance of 325
feet, thence north a distance of 1,340 feet to a point that is
10 feet south of the north line of the NW 1/4 of the SE 1/4 of
said Section 22, which is 980 feet west of the point of
beginning, thence east 980 feet to the point of beginning, the
northeast corner of the NW 1/4 of the SE 1/4 of said Section
22, LESS AND EXCEPT the following streets and alleys in
Fairview Addition to the City of Little Rock: Louisiana Street
from the south line of Florence Avenue to the north line of
Fairview Addition, Florence Avenue from the west line of
Louisiana Street to the east line of Spring Street, Spring
Street from the north line of Florence Avenue to the south
line of Fairview Avenue, Center Street from the south line of
Fairview Avenue to the north line of Florence Avenue, the
alley in Block 11, Center Street from the south line of Lot 2,
Block 2, and Lot 11, Block 1 to the north line of Fairview
Addition and the alley in Block 2 from the south line of Lots
2 and 11, Block 2, to the north line of Fairview Addition, the
area being vacated containing 33.97 acres more or less.
The particular streets and alleys being vacated are:
All of Central Avenue, all of Ouachita Avenue, Florence
Avenue from the west side of Spring Street to the west
line of Fairview Addition, Fairview Avenue from the east
line of Fairview Addition to the east line of Center
Street, Fairview Avenue from the west line of Spring
Street to the west line of Fairview Addition, Louisiana
Street from the south line of Fairview Addition to the
south line of Florence Avenue, Center Street from the
south line of Fairview Addition to the south line of
Fairview Avenue and from the north line of Florence
Avenue to the north line of Lot 3, Block 2 and Lot 10,
Block 1, Spring Street from the south line of Fairview
Addition to the south line of Fairview Avenue and from
the north line of Florence Avenue to the north line of
Fairview Addition, Broadway Street from the south line of
Fairview Addition to the north line of Fairview Addition,
Arch Street from the south line of Fairview Addition to
the north line of Fairview Avenue and the alley in Block
1, the alley in Block 2 from the north line of Lots 3 and
10 to the south line of Block 2, the alleys in Blocks 3,
4, 5, 6, 7, 8, 9, 10, 12, 13, 14, 15, and 16.
Subject to right -of -way agreement in favor of Arkansas
Louisiana Gas Company from Big Rock Stone & Material Company
recorded in Book 822 at page 243 on January 28, 1963 and as
shown in Plat Book 12 at page 9.

SECTION 2. This Ordinance shall be in full force and effect
from and after the date of its passage.
