AN ORDINANCE VACATING A WATERLINE EASEMENT
IN LOTS 4 AND 5, BU LER COMMERCIAL SUBDIVISION AN ADDITION
TO THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the Board of Directors of the City of Little
Rock, Arkansas on the 3rd day of November , 1994, asking the Board of Directors
to vacate all that portion of the waterline easement designated on exhibit "A ", being a part of
the waterline easement, now appearing of record in Book A , Page 821 and in Plat Book E ,
Page 36 , in the office of the Recorder of Pulaski County, Arkansas.
WHEREAS, after due notice as required by law, the Board has, at the time and place
mentioned in the notice, heard all persons desiring to be heard on the question and has
ascertained that the easement, or portion thereof, hereinbefore described, has heretofore been
dedicated to the public use as a waterline easement herein described; that all the owners of the
property abutting upon the portion of the utility easement to be vacated have filed with the Board
their written consent to this action; and that public interest and welfare will not be adversely
affected by the vacating of the utility easement.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its
rights, together with the rights of the public generally, in and to the waterline easement
designated as follows:
15 FEET WATER LINE EASEMENT ABANDONMENT DESCRIPTION
A 15' wide Water Line Easement Abandonment across part of Lot 5 and part of Lot 4, Bixler
Commercial Subdivision to the City of Little Rock, Pulaski County, Arkansas, being more
particularly described as follows:
Starting at the Northwest comer of Lot 4, Bixler Commercial Subdivision as shown in Plat Book
A at Page 821; thence South 88 °15'20" East along the North line of Lot 4 a distance of 174.44
feet to the centerline of the 15' wide water line easement; thence South 00 042'46" West 20.00
feet to the POINT OF BEGINNING of the centerline of a 15' wide Water Line Easement
Abandonment lying 7.5' on each side of the described centerline; thence continuing along the
said centerline the following four (4) courses and distances; thence
(1) South 00 042'46" West 266.45 feet;
(2) South 45 °42'46" West 164.00 feet;
(3) South 00 142'46" West 136.00 feet;
(4) South 44 °17'14" East 132.82 feet
to the POINT OF TERMINATION of the said centerline of 15' wide Waterline Easement
Abandonment, containing 10,489 square feet, more or less.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed
in the Office of the Recorder of Pulaski County and recorded in the records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and after its passage
and approval.
