AN ORDINANCE AMENDING CHAPTER 36 OF
THE LITTLE ROCK, ARK., REVISED CODE
(1988) TO PROVIDE AUTHORITY TO
ACCEPT CONDITIONS IN A GENERAL
REZONING APPLICATION AT THE REQUEST
OF THE APPLICANT; DECLARING AN
EMERGENCY AND FOR OTHER PURPOSES.

NOW, THEREFORE, BE IT.ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1: Section 36 -85 of Little Rock, Ark. Rev.
Code (1988) is hereby amended to add the following subsection:
(e) If it is determined in the course of review of
an amendment that certain conditions requested by
the applicant may be appropriate in order to affect
a change in zoning of the property, the application
may be amended. In such cases, the planning
commission or the board of directors shall determine
the need for deferral of the application for further
notice or review of the design elements to be
incorporated into the ordinance reclassifying the
property.
SECTION 2. Emergency Clause. The Little Rock Board of
Directors deems it necessary to amend the zoning ordinance to
authorize applicants for a change in zoning of property to offer
conditions to the rezoning proposal, in order to mitigate
potential adverse impacts of the development on the surrounding
neighborhood. Several developments currently proceeding through
the review process depend on the authority of the City to grant
the conditional zoning of the property. In order to avoid delay
and costly deferral of pending applications, and to provide
stability to City land use decisions, an emergency is declared

to exist and this ordinance shall take effect immediately on the
date of its passage to protect the health, safety and welfare of
the citizens of the City of Little Rock.
