4 ORDINANCE NO. 16,561 (DECEMBER 21, 1993), THE 1994 BUDGET
5 ORDINANCE, AND TO PROVIDE FUNDS FROM THE ONE -HALF
6 CENT SALES TAX REVENUES TO FUND A TEACHER'S POSITION
7 IN THE STEP ONE ALTERNATIVE SCHOOL AT THE PULASKI
8 COUNTY JUVENILE JUSTICE COMPLEX; DISPENSING WITH THE
9 REQUIREMENT FOR COMPETITIVE BIDDING AND AUTHORIZING

11 THE CITY MANAGER TO ENTER INTO A CONTRACT WITH
12 PULASKI COUNTY TO ADMINISTER THE PROGRAM; DECLARING
13 AN EMERGENCY; AND FOR OTHER PURPOSES.

15 WHEREAS, on December 14, 1993, voters of the City of Little Rock approved
16
a one -half cent local sales tax effective February 1, 1994, to fund various new service
17'
18 initiatives designed to address many needs of the community; and
19 WHEREAS, the Board of Directors established a number of task forces that
20 included Board Members, citizens and staff to evaluate the best methods to implement
21
the initiatives contemplated in the development of the sales tax proposal, and these task
22
23 forces have delivered their recommendations to the Board and requested funding; and
24 WHEREAS, the Prevention Intervention & Treatment Programs Task Force
25 recommended funding a position in the alternative school for 30 expelled students; and
26
27 WHEREAS, the Little Rock public school system will begin its next school year
28 in less than one month; and
29
30 WHEREAS, the City desires to contract with Pulaski County to administer the
31 alternative school program; and
32 WHEREAS, it is not feasible or practical to bid for the contractual aspect of these
33
34 services in a formal bid process.
35 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF

THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The sum of $35,500 is hereby appropriated from the proceeds of
the one -half cent sales tax adopted in December, 1993, and transferred from the General
Fund to the Special Projects Fund and designated for a teacher's position at an
alternative school to be located at, or in association with, the Pulaski County Juvenile
Justice Complex.
SECTION 2. The Board of Directors finds that the need to develop this
alternative school position on an expedited basis in order to have the position in place
during the public school year, and the nature of the program itself, makes it impractical
and unfeasible to competitively bid for such services at the present and, therefore, waives
the requirement of competitive bidding.
SECTION 3. This Ordinance shall be in effect for a period of twelve months
and, in no event, shall the City's obligation to fund this position continue if this payment
exceeds the annual revenues from which the funds are paid.
SECTION 4. The City Manager is authorized to enter into a contract agreement
with Pulaski County for $35,500 to fund the salary and related cost of an alternative
school teacher.
SECTION 5. DECLARING AN EMERGENCY: It is hereby found and
determined that there is an immediate and urgent need to provide the alternative school
services funded by the one -half cent local sales tax approved by the voters of the City
of Little Rock, and that this program is essential for the protection of the public safety
and welfare; an emergency is therefore declared to exist and this Ordinance shall be in
full force and effect from and after the date of its adoption.
