167240 0 ORDINANCE NO. 16,724 390 AN ORDINANCE ESTABLISHING THE OFFENSE OF ATTEMPTING TO PURCHASE ALCOHOLIC BEVERAGES BY A MINOR; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, state law does not prohibit minors from attempting to purchase or otherwise obtain alcoholic beverages; and WHEREAS, the consumption of alcoholic beverages by persons under twenty -one (21) years of age increases the likelihood of disturbances and motor vehicle accidents; and WHEREAS, an ordinance making it unlawful for minors to attempt to purchase or otherwise obtain alcoholic beverages will reduce consumption of such beverages by minors. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1: It shall be unlawful for any person under the age of twenty -one (21) years of age to misrepresent his or her age for the purpose of obtaining liquor, beer or alcoholic beverages. SECTION 2: It shall be unlawful for any person under the age of twenty -one (21) years to attempt to purchase or otherwise obtain any alcoholic beverage from a retail dealer who sells such beverages for off - premises consumption or from a public tavern, restaurant, or other establishment which sells such beverages for on- premises consumption. SECTION 3: It shall be unlawful for any person under the age of twenty -one (21) years to attempt to purchase or otherwise obtain any alcoholic beverage at a private club. SECTION 4: Any person convicted of violating Sections 1, 2 or 3 above shall be punished by a fine of not less than $100 and not more than $500. SECTION 5: (a) The manager of any public establishment which sells alcoholic beverages for on- premise or off - premise a�1 � -9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 0 0 consumption, and the manager of any private club which serves alcoholic beverages for on- premise consumption shall be required to post in a conspicuous place a notice stating: NNOTICE TO PERSONS UNDER 21 YEARS OF AGE 6191 You are subject to a $500 fine for: (1) Misrepresenting your age for the purpose of obtaining liquor, beer, or alcoholic beverage. (2) Attempting to purchase or otherwise obtain liquor, beer, or alcoholic beverage." (b) The size of the notice shall not be less than 8 1/2 inches by 11 inches. The lettering on the notice shall be clearly legible. (c) Any establishment which sells alcoholic beverages at a drive -in window shall post a separate notice at each drive -in window. SECTION 6: That all ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of the conflict. SECTION 7: That the provisions of this Ordinance are hereby declared to be severable and if any section, phrase or provision shall be declared or held invalid, such invalidity shall not affect the remainder of the sections, phrases or provisions. SECTION 8: EMERGENCY. It has been found and determined that the immediate passage of this ordinance is necessary for the preservation of public health, safety, and welfare of the citizens of Little Rock; therefore, an emergency is hereby declared to exist and this Ordinance shall be in full force and effect from and after its passage and approval.
