16715ORDINANCE NO. 16,715 t AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT 372 IN BLOCKS 18 AND 19 OF NEIMEYER GROVE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 8th day of June, 1994, asking the Board of Directors to vacate a portion of the public utility easement designated by City Ordinance No. 16,495, now appearing of record in the office of the Recorder of Pulaski County. WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement, or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows: All that portion of a public utility and drainage easement retained in the westerly 28 feet of now closed Anglin Street adjacent to part of Block 19, Neimeyer Grove Addition, lying north of the northernmost point of Lot 222, St. Charles Addition and south of the south line of Lot 229, St. Charles Addition. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 3.
