AN ORDINANCE TO ESTABLISH CONTROLS

RELATED TO THE USE OF ABOVEGROUND

STORAGE TANKS FOR FLAMMABLE LIQUIDS AND

LIQUEFIED PETROLEUM GASES.

WHEREAS, The Board of Directors of the City of Little
9
Rock have determined that the storage of flammable liquids in
10
aboveground tanks presents a hazard to the public's health,
11
safety and welfare; and,
12
WHEREAS, the proliferation of such aboveground tanks is
13
the result of extensive regulations on underground tanks.
14
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
15
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. It shall be unlawful for any person to store
17
Class I or Class II flammable and combustible liquids, as
18
defined by the Arkansas Fire Prevention Code, in aboveground
19
storage tanks unless such tanks are installed in conformance with
20
the Arkansas Fire Prevention Code or the National Fire Protection
21
Association Standard No. 30 entitled "Flammable and Combustible
22
Liquids Code ". The Fire Chief, or his designated agent, shall
23
have the authority to require the removal of any aboveground
24
storage tanks not in compliance with said standards upon a
25
determination that the tank creates a safety hazard to life
26
and /or property.

SECTION 2. The storage of Liquefied Petroleum Gases in
28
aboveground tanks is prohibited in any of the designated Fire
29
Districts of the City of Little Rock provided, that this
30
prohibition shall not apply to tanks existing upon the passage
31
of this Ordinance which are installed in compliance with the
32
requirements of "Arkansas Fire Prevention Code" and the "State
33
Code, Liquefied Petroleum Gas Container and Equipment."

SECTION 3. Nothing in this ordinance shall prohibit

the use of Class II liquids in outside aboveground tanks having
capacities of less than 600 gallons for temporary use. Nothing
in this Ordinance shall prohibit the storage of fuels for farm,
factory or industrial use, fleet servicing of private vehicles
on sites 5 acres or more in size, with tanks located a minimum
of 150 feet from common property lines or adjacent right -of -way.
SECTION 4. Penalty. Any person convicted of a violation
of any of the provisions of this article shall be punished as
provided in sections 1 -9.
SECTION 5. Declaring an emergency. An emergency is hereby
declared to exist, and this ordinance, being necessary for the
preservation of the public health, safety, and welfare shall
take effect and be enforced from and after the date of its
passage.
