AN ORDINANCE AMENDING CHAPTER 31 OF THE
CODE OF ORDINANCES OF THE CITY OF LITTLE
ROCK, ARKANSAS PROVIDING FOR A WAIVER OF
PAVEMENT WIDTH AND ARTERIAL STREET
CONSTRUCTION REQUIREMENTS REGARDING THE
PRESENTLY PROPOSED STONEHEDGE
SUBDIVISION, AND OTHER MATTERS.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Chapter 31 of the Code of Ordinances be
amended to provide for waiver of certain requirements within the
Subdivision Regulations of the City of Little Rock as such shall
be applied to and required of the Stonehedge Subdivision as
follows:
Subsection a. That Section 31 -397 of the Code of Ordinances
be amended to provide waiver of Subdivision Regulations to allow a
24 foot pavement width and modified street construction of West
Street and Stonehedge Drive.
Subsection b. That Section 31 -397 of the Code of Ordinances
be amended to provide for waiver of Subdivision Regulations and
Master Street Plan provisions requiring arterial street
construction on 36th Street.
Subsection c. The agreement executed by the City of Little
Rock and The Linkous Co., Inc., relating to the above waivers,
dated April 13, 1990 is approved.
SECTION 2. This ordinance shall take effect thirty (30)
days from and after its passage.

AGREEMENT

This agreement is entered into on the date stated on the
last page hereof by and between The City of Little Rock, hereafter
referred to as "the City ", and The Linkous Co., Inc., hereafter
referred as "the Developer ".
WITNESSETH:
WHEREAS, there is a need in the City for available
affordable homes for the residents and prospective residents of
the City; and
WHEREAS, the Developer is in the process of developing a
residential subdivision known as Stonehedge Subdivision,
hereafter referred to as "the Development", in the City; and
WHEREAS, the City is willing to waive certain subdivision
requirements which are applicable to the Development; and
WHEREAS, the Developer is willing to commit to the
construction and development of affordable homes in the
Development.
NOW, THEREFORE, in consideration of the mutual covenants,
conditions, and provisions hereof the City and the Developer
agree as follows:
1. Affordable housing or houses as referred to herein shall
mean new single family residential houses priced not to exceed
$50,000 per house.
2. Developer shall construct, develop or make available
for purchase at least seventy five percent (75 %) of the total
houses to be built within the Development as affordable housing.
Developer may construct the remaining 25% of the houses to be
priced not to exceed $60,000.

3. All of the affordable houses within the Development
shall, in addition to all other applicable housing standards and
requirements except those specifically waived herein, be built in
accordance with the following: (a) front and side yards shall be
fully sodded; (b) the front yard shall be landscaped with at
least shrubs along the front of each house and at least two trees,
each having no less than a two -inch base, retained or planted in
the front yard; and (c) the houses shall not be constructed all
in the same architectural style, design or color scheme.
4. Developer shall construct sidewalks along the western
side of West and Stonehedge Streets and along the southern side of
36th Street. These sidewalks shall be constructed immediately
upon the completion of houses on the lots immediately adjacent to
those streets, and all such sidewalks shall be constructed in no
event later than two years from the date of this agreement.
5. Developer shall construct curbs and gutters along West
Street with a subbase of width to equal a 24 foot street.
6. City shall not, as a result of the current scope of the
Development, require Developer to make any improvements to 36th
Street which are generally required of a developer seeking_
approval of subdivision adjacent to an arterial street such as
36th Street.
7. City shall include West Street in the City's annual
chip -seal paving program.
8. City shall require and impose street standards
applicable to Stonehedge and West Streets of a minimum width of
24 feet rather than 27 feet as would normally be required.
9. All standards and requirements applicable to the
Development as provided in the Little Rock City Code of
ordinances, as now in effect or as later amended, and in the final
approved plat regarding the Development shall be applicable to the

Development and the Developer unless specifically in conflict with
any of the provisions hereof.
10. This constitutes the entire agreement between the City
and the Developer regarding the subject matter hereof. There are
no other agreements or understandings between the parties on the
subject matter of this agreement.
11. This agreement shall be binding on the heirs,
successors and assigns of Developer and the City.
12. This agreement shall be binding and effective only upon
its execution by Developer and the City Manager of the City, and
upon its approval by the City of Little Rock Board of Directors.
