15842• DRAFT NO. 3 PAGE 1 130 ORDINANCE ..._15.1,8.42...1_- AN ORDINANCE AMENDING CHAPTER 36, ARTICLE XIII, OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS PROVIDING FOR THE ESTABLISHMENT OF REGULATION OF CERTAIN COMMERCIAL AND PRIVATE VEHICLES IN RESIDENTIAL ZONES. WHEREAS, the Little Rock Zoning Ordinance adopted January 1, 1980 provided no regulation of commercial vehicles or other large vehicles in residential zoning districts. WHEREAS, the health, safety, peace, comfort and general welfare of the citizens of Little Rock are affected by the continuance of this activity. WHEREAS, the Board of Directors of the City of Little Rock, Arkansas wishes to provide for the establishment of regulation of commercial vehicles in residential zones. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 36., .Article XIII, be amended to ....... .............................. provide for . the introduction of a new section to be title "36- 512 Commercial Vehicle Parking, (Prohibited)" and to read as follows: 36 -512 COMMERCIAL VEHICLE PARKING, (PROHIBITED) (a) Except as provided herein, no portion of any lot, tract or parcel of land zoned for residential usage, including districts "R -1" through 1111-7a" and "MF -6" through "MF -24," shall be utilized for the parking of commercial vehicles with a load carrying capacity in excess of one (1) ton. (b) For purposes of this section, the following types of vehicles are expressly prohibited at any time. (1) All commercial tow vehicles or vehicle carriers. (2) Dump trucks or trash haulers. (3) Flat bed or stake bed trucks. (4) Trailers whose designed intent is storage or transport of material or equipment. (5) Trucks or buses used in inter or intrastate commerce. (6) Vans, larger than one ton, used for other than a private passenger vehicle. (7) School or church buses or vans exceeding one ton in carrying capacity. DRAFT NO. 3 PAGE 2 131 SECTION 2. That Chapter 36., Article XIII, be amended to ............ f.......... __....... . provide or the introduction of a new section to be titled "36- 513 Vehicle Parking in Residential Zones, (Permitted)" and to read as follows: 36 -513 VEHICLE PARKING IN RESIDENTIAL ZONES, (PERMITTED) (a) Any portion of a lot, tract or parcel of land zoned for residential usage, including districts "R -1" through "R -7a" and 'IMF-6" through 'IMF-24", may be utilized for the parking of private passenger vehicles unless prohibited by other provisions of the Zoning Ordinance. SECTION 3. That Chapter 36., Article XIII, be amended to provide for the introduction of a new section to be titled "36 -514 Exclusion for Public Service and Repair Vehicles" and to read as follows: SECTION 36 -514 EXCLUSION FOR PUBLIC SERVICE AND REPAIR VEHICLES. For purposes of Section 36 -512, all vehicles engaged in public service work or repair services such as utilities, drainage and /or street maintenance, delivery vehicles or contractors shall be exempt. This vehicle must be engaged in the service or repair rendered and not stored for use off -site. Further, any vehicle of a commercial nature that is on -call for emergency service purposes such as a utility repair van shall be permitted at any time. SECTION_4. That Chapter 36., Article XIII, be amended to provide for the introduction of a new section to be titled 1136 -515 Variance" and to read as follows: 36 -515 VARIANCE The Planning Director may approve variances from the provisions established by Section 36 -512 provided the property owner can evidence a circumstance or hardship unique to the property. Appeals of the action taken by the Planning Director may be filed with the Little Rock Board of Adjustment within thirty (30) days of the action of the Planning Director. SECTION 5.
