3 AN ORDINANCE WAIVING THE REQUIREMENT FOR
4 COMPETITIVE BIDDING; AUTHORIZING THE CITY
5 MANAGER TO ENTER INTO A CONTRACT WITH
6 ENGINEERING MANAGEMENT CORPORATION TO PROCURE
7 APPROVAL OF ASBESTOS ABATEMENT PLANS,
8 NEGOTIATE, PROCURE AND SUPERVISE ABATEMENT OF
ASBESTOS, TO CONDUCT FINAL CLEARANCE AND
9 RELATED MATTERS; AND FOR OTHER PURPOSES.

12 WHEREAS, the City of Little Rock is about to demolish
certain buildings within the City of Little Rock Which contain
13 asbestos; and
14 WHEREAS, in order to comply with the laws and regulations
15 regarding asbestos abatement and to reduce any risk of exposure to
16 the public, it is necessary to retain the services of licensed,
17 trained individuals to carry out the abatement, and
WHEREAS, insufficient time is available to competitively
18 bid the services needed as described above which must be initiated
19 and completed in time to allow the demolition of the structures
20 during the month of September, 1990.
21 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK:

Section 1. The City Manager is authorized to enter into a
23 contract with Engineering Management Corporation (EMC) for an
24 amount not to exceed $30,000.00, to be paid out of the Housing
25 Demolition Revolving Fund, to develop asbestos abatement plans,
26 negotiate, procure and supervise the services of a licensed,
certified asbestos abatement contractor, to conduct final
27 clearance and inspection of the site of the buildings to be
28 demolished and for other matters related thereto.
29 Section 2. Because there is insufficient time to
30 competitively bid the required services which must be completed
31 during August, 1990 so that the demolition can be commenced and
completed during the month of September and because the nature of
32 the services to be provided by EMC are unique and because of the
33 need of the City to work with an experienced and trained company,
34 the Board of Directors finds that it is impractical and infeasible
35 to competitively bid for the services to be provided by EMC and
36 such requirement is therefore waived.
