3 AN ORDINANCE APPROPRIATING $75,000 FROM THE IN-
4 LIEU CONTRIBUTION FUND FOR GRADE CHANGES AND
5 IMPROVEMENTS TO APPROXIMATELY 600 LINEAR FEET
OF SOUTH BOWMAN ROAD; AUTHORIZING THE CITY MANAGER

TO ENTER INTO A CONTRACT WITH WINROCK DEVELOPMENT
7 CO.; AND TO WAIVE COMPETITIVE BIDDING FOR THIS
8 CONTRACT.

WHEREAS, Winrock Co. has constructed several phases of the
11 Sandpiper West subdivision adjacent to this portion of Bowman
12 Road; and
13 WHEREAS, at the City's request, Winrock has paid into the
14 city's In -Lieu Fund the estimated cost of the improvements
15 instead of contructing half- street improvements; and
WHEREAS, Winrock's contributions to date total $79,186.26;
16 and
17 WHEREAS, improvements to South Bowman Road will consist of
18 grading the street to a roadbed shape for a future five -lane
19 section, and constructing a three -lane section with shoulders.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
21 SECTION 1: The sum of $75,000 is hereby appropriated from
22 the In -Lieu Contribution Fund for.grade changes and improvements
23 to approximately 600 linear feet of South Bowman Road.
24 SECTION 2: The City Manager is authorized to enter into a
contract with Winrock Development Co, to construct the desired
25 improvements to South Bowman Road.
26 SECTION 3: This project has been developed in phases by
27 Winrock Development Company. Some necessary street improvements
28 have been delayed until a particular phase of the development has
29 been reached. To assure that the City would not have to pay for
the improvements at the time a; particular phase is begun, Winrock
30 has been required to pay into a special City fund the estimated
31 costs of the improvements to be held in trust in the event Winrock
32 does not fulfill its obligation to complete the improvements.
33 Since Winrock is fulfilling that obligation, then the City no
longer needs to hold the funds in trust, but needs to return them
34 to Winrock through this contract. Since, once the improvements

are completed, the funds are Winrock's funds anyway, it is
unnecessary to submit this contract to competitive bidding.
