158741 ORDINANCE NO. 15.874 221 2 AN ORDINANCE VACATING AND CLOSING A PORTION OF AN 3 ALLEY IN BLACK 5, PLATEAU ADDITION TO THE CITY OF 4 LITTLE ROCK AND VACATING AND CLOSING WEST FOURTH 5 STREET BETWEEN SOUTH EIM AND SOUTH CEDAR STREETS 6 IN PLATEAU ADDITION TO THE CITY OF LITTLE ROCK, 7 ARKANSAS; AND FOR OTHER PURPOSES. 8 WHEREAS, a petition was duly filed with the Board of 9 Directors of the City of Little Rock, Arkansas, on the 29th day of 10 March, 1990, asking the Board of Directors to vacate and abandon a 11 portion of an alley in Block 5, Plateau Addition to the City of 12 Little Rock, Arkansas, and to vacate and abandon West Fourth Street lying between South Elm Street and South Cedar Street, 13 Plateau Addition to the City of Little Rock, Arkansas, as 14 designated on the plat of said Addition now appearing of record in 15 Plat Book AB, page 252, in the office of the Circuit Clerk and Ex 16 Officio Recorder of Pulaski County, Arkansas, subject, however, to any public utility easements in the said street; and 17 WHEREAS, after due notices as required by law, the Board of 18 Directors has, at the time and place mentioned in the Notice, 19 heard all persons desiring to be heard on the question and has 20 ascertained that the portions of street and alley, hereinbefore 21 described, have heretofore been dedicated to the public use as a street and alley, as herein described; that the petitioners are 22 the owners of the property abutting upon the street and alley to 23 be vacated; and that public interests and welfare will not be 24 adversely affected by the abandonment of portions of said street 25 and alley; and WHEREAS, the University of Arkansas for Medical Sciences 26 (DAMS) has obtained a recommendation of approval for the street 27 and alley closure from the Little Rock Planning Commission based 28 on its review of the UAMS site plan and landscaping plan, as 29 evidenced in Exhibits A and B, which are attached hereto and 30 made a part hereof; and WHEREAS, in determining the desirability and necessity of 31 closure, UAMS and the City of Little Rock have entered into mutual 32 understandings and assurances as evidenced in Exhibit C which is 33 attached hereto and made a part hereof. 34 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 35 THE CITY OF LITTLE ROCK, ARKANSAS: 36 b d "`t 222 SECTION 1. Based on the mutual understandings and 1 assurances between UAMS and the City, the site plan and 2 landscaping plan, all heretofore attached and made a part hereof, 3 the Board of Directors hereby determines the desirability and 4 necessity of closing a portion of West Fourth Street and a portion 5 of said alley as hereinafter described for the purpose of constructing an addition to the UAMS medical complex. 6 SECTION 2. Except as stated in Section 2 below, the City 7 of Little Rock, Arkansas, hereby releases, vacates and abandons 8 all of its rights, together with the rights of the public 9 generally, in and to the street and alley designated as follows: 10 Beginning at the Northwest corner of Lot 9, Plateau 11 Addition to the City of Little Rock, thence South 12 approximately 250 feet to the Southwest corner of Lot 13 13, Block 5, Plateau Addition to the City of Little 14 Rock, thence West 16 feet to the Southeast corner of 15 Lot 14, Block 5, Plateau Addition to the City of Little Rock, thence North approximately 250 feet to 16 the Northeast corner of Lot 18, Block 5, Plateau 17 Addition to the City of Little Rock, thence East 16 18 feet to the point of beginning. 19 20 and 21 All that portion of West Fourth Street lying between 22 South Elm Street and South Cedar Street also 23 described as follows: Beginning at the Southeast 24 corner of Lot 13, Block 5, Plateau Addition to The City of Little Rock, thence South 50 feet to the 25 Northeast corner of Lot 1, Block 12, Plateau Addition 26 to the City of Little Rock, thence West approximately 27 272.5 feet to the Northwest corner of Lot 12, Block 28 12, Plateau Addition to the City of Little Rock, 29 thence North 50 feet to the Southwest corner of Lot 14, Block 5, Plateau Addition to the City of Little 30 Rock, thence East approximately 272.5 feet to the 31 Southeast corner of Lot 13, Block 5, Plateau Addition 32 to the City of Little Rock, being the point of 33 beginning. 34 Subject, however, to any public utility easements located 35 36 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 0 9 in said street. SECTION 3. The City specifically retains the right to use, and allow others to use, the former street right -of -way in its entirety as a public utility and drainage easement. SECTION 4. Abutting owners of record, receiving title to the abandoned right -of -way and easement of the street shall at their cost remove all vestiges of public use and access as may exist; such modifications shall include, but are not limited, to the following: A. The entrances on both ends of the abandoned right -of -way and easement shall be off -set and /or rebuilt to conform to the standard driveway designed as required by ordinance No. 12501. 223 B. The edge of pavement of the right -of -way shall be rebuilt to conform to existing conditions in the general vicinity where the abandoned right -of -way and easement intersects with the remaining public right -of -way. SECTION 5. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the Office of the Pulaski County Circuit Clerk and Ex Officio Recorder and recorded in the Deed Records of the County. SECTION 6. This ordinance shall take effect and be in force from and after its passage. Dalton City Manager City Hall Markham at Broadway Little Rock, AR 72201 EXHIBIT C • RE: UAMS Expansion Commitments Dear Mr. Dalton: M 1=1 M 226 This letter is to set forth the additional understandings and information we have submitted which you requested as part of the alley and 4th Street closure application for the UAMS research facility. The following are the understand- ings and assurances: 1. The current UAMS Campus Facilities Plan envisions the location of the Biomedical Research Center between Elm and Cedar Streets as one of the last major planned eastward expansions of the UAMS currently to be under- taken within the corridor bounded by Cedar and Elm Streets. The plan also notes that expansion of outpatient activities may be locted between Cedar and Elm and 5th and 6th Streets. There are, however, no current plans actively underway for such a facility. You are also aware that the block south of the research facility has been mentioned as a possible site for a parking deck. 2. The current UAMS Campus Facilities Plan envisions some acquisition north of Markham which would be limited to office support facilities. No major research or major medical facilities currently are planned north of Markham. 3. The construction of the Biomedical Research Center will be constructed in conformance with the Wittenberg, Delony & Davidson site plan dated March 26, 1990, and reviewed by the Planning Commission of the City of Little Rock. 4. The Board of Trustees of the University of Arkansas at its May 4, 1990, meeting has given its assurances that the Biomedical Research Center's landscaping and buffering will be installed and maintained in confor- mance with the Wittenberg, Delony & Davidson landscap- ing plan dated May3, 1990, and reviewed by the Planning Commission of the City of Little Rock. 0 • 227 Mr. Dalton Page 2 May 8, 1990 5. The alley (to be partially closed) will be terminated north of the proposed Research Center and will not con- nect to Cedar. 6. It is understood that due to budgetary constraints in the bidding process, there may be minor architectural changes to the biomedical building, but no substantial changes will be made to the landscaping and buffering plan without first reviewing such changes with the Planning Director of the City of Little Rock. The UAMS understands that the City feels that the impact of the street and alley closures and expansion of the Medical Center in proximity of the adjoining neighborhoods will be minimized by the above.
