AN ORDINANCE GRANTING A FRANCHISE TO WESTERN
UNION ATS, INC. TO USE PART OF THE PUBLIC
RIGHT -OF -WAY FOR THE PLACEMENT OF FIBER OPTIC
CABLE AND CONDUIT; DIRECTING THE CITY MANAGER
AND CITY ATTORNEY TO NEGOTIATE A NEW FRANCHISE
AGREEMENT WITH WESTERN UNION; AND FOR OTHER PURPOSES.
Now, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1: A franchise is hereby granted to Western Union
ATS, Inc. to use a part of the public right -of -way generally
described as beginning one block west of Scott Street and half of
a block north of Second Street, continuing to the sidewalk south
of Markham Street, thence continuing to the east side of Scott
Street, and traveling north across Markham Street to the sidewalk
east of Scott Street to State right -of -way, crossing north over
LaHarpe Blvd., to the Union Pacific Railroad right -of -way and more
specifically as detailed in Western Union's Project Manual #08828,
for placement of fiber optic cable and conduit.
SECTION 2: The granting of this franchise shall be subject
to the applicant's adherence to utilize the One Call System 48
hours prior to construction commencement to give all utilities
ample opportunity to more accurately mark the location of existing
utilities located near the proposed construction route.
SECTION 3: Subject to the provisions of Section 4, this
ordinance shall remain in full force and effect from and after its
adoption and approval. The City reserves the right to revoke said
franchise approval in the event of failure to negotiate a new
franchise agreement between Western Union and the City as set
forth in Section 4; to comply with the requirements of approval;
or in the event of a public need superior to the use granted.
SECTION 4: This franchise shall be in effect until a new

franchise agree t with Western Union is place. The City 2 01
Manager and CitPAttorney are directed to gotiate a new
franchise agreement to be in place no later than January 1, 1992.
