16135475 ORDINANCE NO. 16,135 AN ORDINANCE VACATING A PUBLIC UTILITY EASEMENT IN LOT 33, PLEASANT VALLEY ESTATES ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 16th day of October. 1991, asking the Board of Directors to vacate a portion of the public utility easement designated on the plat of Lot 33 of Pleasant Valley Estates Addition to the City of Little Rock, Arkansas, now appearing of record in Plat Book A, Page 859, in the Office of the Recorder of Pulaski County, Arkansas. WHEREAS, after due notice as required by law, the Board has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the easement, or portion thereof, hereinbefore described, has heretofore been dedicated to the public use as a utility easement herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all the owners of the property abutting upon the portion of the utility easement to be vacated have filed with the Board their written consent to this action; and that public interest and welfare will not be adversely affected by the vacating of the utility easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the utility easement designated as follows: Part of Lot 33, Pleasant Valley Estates, more particularly described as: Beginning at the BE corner of said easement, thence N oo 19' N along the east line of said easement for 75 feet; thence N 880 53' E along the north line of said easement 50 feet, thence s 000 19' E along the west line of the said easement to the 100 year flood plain line; thence along the flood plain line for 50 feet and along the north line of the 10 foot easement for 5 feet to the point of beginning. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County and recorded in the records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage and approval.
