191581 2 3 4 5 6 7 ORDINANCE NO. 19,158 88/2N/2604 69:19:42 Ah filed A Recorded in Official Records of CAROLYN SfALEY PULASKI COUNTY CiRCUlf /COUNTY CLERK Fees sll.66 AN ORDINANCE TO VACATE AND ABANDON A PORTION OF THE PUBLIC RIGHT -OF -WAY LOCATED ON THE EASTERNMOST END OF GOOCH ROAD, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. 8 WHEREAS, a request was made to abandon a portion of the public right -of -way 9 on the easternmost end of Gooch Road, located West of Heatherbrae Phase III, 10 pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54- 11 104; 12 WHEREAS, the Board has determined that the abandoning of this portion of the 13 public right -of -way will not have an adverse impact on the adjacent property owners 14 nor the local traffic, and therefore, the right -of -way abandoned by this ordinance is no 15 longer needed for corporate purposes except as otherwise noted below. 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS 17 OF THE CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. The Board of Directors hereby releases, vacates, and abandons the 19 portion of the said right of way on the easternmost end of Gooch Road, located West of 20 Heatherbrae Phase III, together with the right of public in general, in the City of Little 21 Rock, Pulaski County, Arkansas. 22 Section 2. The City specifically reserves the existing fifteen -foot wastewater sewer 23 24 25 26 easement within the former right -of -way. Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in e)� Pulaski County, Arkansas. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
