ORDINANCE NO. 16,091
AN ORDINANCE AMENDING ORDINANCE NO. 16,060 OF
THE CITY OF LITTLE ROCK (RELATING TO AN
ELECTION TO APPROVE THE ISSUANCE OF BONDS AND
THE LEVY OF A ONE -HALF OF ONE PERCENT LOCAL
SALES AND USE TAX); AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION ONE. That Section 2 of Ordinance 16,060 of the City
of Little Rock is amended to read as follows:
SECTION 2. That in order to provide for the payment of
the principal of and interest of the Bonds, there is hereby levied
the Sales and Use Tax. The levy of the Sales and Use Tax shall not
be effective until after the special election called in Section 1
above has been held and the issuance of Bonds for some or all of
the proposed purposes is approved by the voters. The Sales and Use
Tax shall be levied and collected only to a maximum tax of $25 for
each single transaction. "Single transaction" is defined according
to the nature of the goods purchased as follows:
A. When two or more devices in which or by which any person
or property is, or may be, transported or drawn, including but'not
limited to on -road vehicles, whether required to be licensed or
not, off -road vehicles, farm vehicles, airplanes, water vessels,
motor vehicles, or non - motorized vehicles, and mobile homes, are
sold to a person by a seller, each individual unit, whether part of
a "fleet" sale or not, shall be treated as a single transaction for
the purpose of the Sales and Use Tax.
B. The charges for utility services, which are subject to
the Sales and Use Tax, and which are furnished on a continuous
service basis, shall be computed in daily increments, and each such
daily charge increment shall be considered to be a single
transaction for the purposes of the Sales and Use Tax.
C. For sales of building materials and supplies to
contractors, builders or other persons, a single transaction, for
the purposes of the Sales and Use Tax, shall be deemed to be any
single sale which is reflected on a single invoice, receipt or
statement, on which an aggregate sales (or use) tax figure has been
reported and remitted to the State of Arkansas.
D. When two or more items of major household appliances,
commercial appliances, major equipment and machinery are sold, each
individual unit shall be treated as a single transaction for the
purposes of the Sales and Use Tax.

E. For groceries, drug items, dry goods and other tangible
personal property and /or services not otherwise expressly covered
in this section, a single transaction shall be deemed to be any
single sale which is reflected on a single invoice, receipt or
statement, on which an aggregate sales tax figure has been reported
and remitted to the State of Arkansas.
SECTION TWO. That Section 3 of Ordinance No. 16,060 of the
City of Little Rock is amended to read as follows:
SECTION 3. That the question of issuing Bonds for each
purpose and the levying of the Sales and Use Tax for retirement of
the Bonds shall be placed on the ballot for the election in
substantially the following forms:
Question No. 1
STREET IMPROVEMENT BONDS
Vote FOR or AGAINST the issuance of bonds to finance Street
Improvements and the levy of a sales and use tax for the purpose of
retiring these and other bonds approved by the voters. The Street
Improvements include repair and replacement of street surfaces;
construction and improvement of sidewalks, gutters and lighting;
widening of streets; construction of new streets; repair of
alleyways; placement of traffic signals; and alteration of streets
to better provide for handicapped access and handicapped parking.
FOR the issuance of bonds in the maximum principal amount of
$10,000,000 for the purpose of financing Street Improvements and
the levy of a one -half of one percent (0.5 %) sales and use tax
within the City of Little Rock for the purpose of retiring these
bonds and such other bonds as are approved in this election and
issued ....................... ............................... =
AGAINST the issuance of bonds in the maximum principal amount
of $10,000,000 for the purpose of financing Street Improvements and
the levy of one -half of a one percent (0.5%) sales and use tax

DRAINAGE IMPROVEMENT BONDS
Vote FOR or AGAINST the 'issuance of bonds to finance Drainage
Improvements for the City of Little Rock and the levy of a sales
and use tax for the purpose of retiring these and other bonds
approved by the voters. The Drainage Improvements include
constructing curbs and gutters, providing other drainage and flood
control facilities and providing facilities for the treatment of
storm drainage water.

Zoo Improvements and the levy of a sales and use tax for the
purpose of retiring these and other bonds approved by the voters.
The Little Rock Zoo Improvements include improvements to the
children's zoo, construction of a zoo education and administration
building, improvements to zoo walks and driveways, landscaping,
improvements to the mechanical and electrical systems, expansion of
animal displays, acquisition of new animals for exhibit,
improvements to and new construction of concession stands,
construction of facilities for the elderly, the handicapped and
children, the construction of facilities for the care and feeding
of zoo animals, improvements to the water and sewer facilities,
expansion of areas, purchase of furnishings, equipment and
fixtures, and improvements to or expansion of zoo parking
facilities.
FOR the issuance of bonds in the maximum principal amount
$2,500,000 for the purpose of financing Little Rock Zoo
Improvements and the levy of a one -half of one percent (0.5 %) sales
and use tax within the City of Little Rock for the purpose of
retiring these bonds and such other bonds as are approved in this

$2,500,000 for the purpose of financing Little Rock Zoo

HOUSING ASSISTANCE BONDS

Vote FOR or AGAINST the issuance of bonds for a Housing
Assistance Project and the levy of a sales and use tax for the
purpose of retiring these and other bonds approved by the voters.
The Housing Assistance Project consists of the acquisition of land
and existing substandard housing and demolition of substandard
housing, in conjunction with City of Little Rock Programs for
residential housing for low and moderate income, elderly or
handicapped persons and families.
FOR the issuance of bonds in the maximum principal amount of
$2,000,000 for the purpose of financing the Housing Assistance
Project and the levy of a one -half of one percent (0.5 %) sales and
use tax within the City of Little Rock for the purpose of retiring
these bonds and such other bonds as are approved in this election

AGAINST the issuance of bonds in the maximum principal amount
of $2,000,000 for the purpose of financing the Housing Assistance
Project and the levy of a one -half of one percent (0.5 %) sales and

PARK IMPROVEMENT BONDS
Vote FOR or AGAINST the issuance of bonds to finance Park
Improvements and the levy of a sales and use tax for the purpose of
retiring these and other bonds approved by the voters. The Park
Improvements consists of the acquisition and improvement of park
properties for the City of Little Rock, which may include land
acquisition and construction of improvements within the parks,
including soccer fields, golf courses, water and sewer lines and
facilities, concession stands, amusement rides, biking, jogging and
nature trails, tennis courts, baseball fields, exercise areas,
dressing areas, restrooms, pavilions, outdoor cooking and camping
facilities, spectator stands and press boxes, swimming pools,
boating areas, and boat launching docks.
FOR the issuance of bonds in the maximum principal amount of
$7,500,000 for the purpose of financing Park Improvements and the
levy of a one -half of one percent (0.5%) sales and use tax within
the City of Little Rock for the purpose of retiring these bonds and
such other bonds as are approved in this election and

STATEHOUSE CONVENTION CENTER BONDS
Vote FOR or AGAINST the issuance of bonds to finance a
Statehouse Convention Center Expansion Project and the levy of a
sales and use tax for the purpose of retiring these and other bonds
approved by the voters. The Statehouse Convention Center Expansion
Project consists of increasing the exhibition and meeting space,
providing necessary furnishings, fixtures and equipment, developing
lighting and sound systems for the additional space, doing
necessary demolition work and sitework preparation, acquiring
necessary land and rights -of -way, widening streets, and incidental
mechanical and electrical work.
FOR the issuance of bonds in the maximum principal amount of
$15,175,000 for the purpose of financing the Statehouse Convention
Center Expansion Project and the levy of a one -half of one percent
(0.5 %) sales and use tax within the City of Little Rock for the
purpose of retiring these bonds and such other bonds as are
approved in this election and issued .......................
AGAINST the issuance of bonds in the maximum principal amount
of $15,175,000 for the purpose of financing the Statehouse
Convention Center Expansion Project and the levy of a one -half of
one percent (0.5 %) sales and use tax within the City of Little Rock
for the purpose of retiring these bonds and such other bonds as are
approved in this election and issued .......................

ARKANSAS ARTS CENTER BONDS
Vote FOR or AGAINST the issuance of bonds to finance one -half of
the costs of Arkansas Arts Center Improvements and the levy of a
sales and use tax for the purpose of retiring these and other bonds
approved by the voters. The Arkansas Arts Center Improvements
include improvements to the mechanical and electrical systems,
sound systems, lighting systems and kitchen facilities; the
acquisition of exhibits; improvements to the water and sewer
facilities; expansion of the Center; purchase of furnishings,
equipment and fixtures; and improvements or expansion of the
parking facilities serving the Center. The balance of the costs of
the Arkansas Arts Center Improvements will be provided from
donations or other revenues of the Arkansas Arts Center.

Stadium Renovation Project and the levy of sales and use tax for
the purpose of retiring these and other bonds approved by the
voters. The War Memorial Stadium Renovation Project consists of
the renovation and expansion of War Memorial Stadium to include the
replacement of the playing surface, construction of new restrooms
and sewer lines, improvements to the concessions area, mechanical
improvements (including sound systems and scoreboard or video
facilities), construction of upper deck areas to increase seating
capacity by approximately 10,000, provision of structural framework
for private spectator suites (to be financed separately), and
improvements to existing offices and team facilities.
FOR the issuance of bonds in the maximum principal amount of
$15,725,000 for the purpose of financing the War Memorial Stadium
Renovation Project and the levy of a one -half of one percent (0.5 %)
sales and use tax within the City of Little Rock for the purpose of
retiring these bonds and such other bonds as are approved in this

Right -of -Way Acquisition Project and the levy of a sales and use
tax for the purpose of retiring these and other bonds approved by

the voters. The Right -o£ -Way Acquisition Project consists of
purchasing land for rights -of -way for improvements to Asher Avenue
and for an extension of the South Loop. The South Loop is a
project to connect Interstate Highway 30 to U.S. Highway 65. The
initial phase of the South Loop connects Mabelvale West Road to
Alexander Road. The proposed estension is from Alexander Road to
Highway 65.
FOR the issuance of bonds in the maximum principal amount of
$2,000,000 for the purpose of financing the Right -of -Way
Acquisition Project and the levy of a one -half of one percent
(0.5 %) sales and use tax within the City of Little Rock for the
purpose of retiring these bonds and such other bonds as are
approved in this election and issued .......................
AGAINST the issuance of bonds in the maximum principal amount
of $2,000,000 for the purpose of financing the Right -of -Way
Acquisition Project and the levy of a one -half of one percent
(0.5 %) sales and use tax within the City of Little Rock for the
purpose of retiring these bonds and such other bonds as are
approved in this election and issued .......................
Question No. 10
MULTIPURPOSE EVENTS CENTER BONDS
Vote FOR or AGAINST the issuance of bonds to finance a
Multipurpose Events Center Project and the levy of a sales and use
tax for the purpose of retiring these and other bonds approved by
the voters. The Multipurpose Events Center Project consists of
acquiring a site (if necessary) , constructing and equipping a
building for multiple use as an auditorium for concerts and other
entertainment functions, an arena for basketball and other sports
and recreational activities, a facility for conventions and
meetings and a facility for trade exhibitions; and providing some
parking for users of the facility. The building will contain shell
space for private spectator suites. The suites will be financed
separately.
FOR the issuance of bonds in the maximum principal amount of
$42,100,000 for the purpose of financing the Multipurpose Events
Center Project and the levy of a one -half of one percent (0.5 %)
sales and use tax within the City of Little Rock for the purpose of
retiring these bonds and such other bonds as are approved in this
election and issued ........... ..............................=
AGAINST the issuance of bonds in the maximum principal amount
of $42,100,000 for the purpose of financing the Multipurpose Events

IMAX THEATER FOR THE MUSEUM OF SCIENCE AND HISTORY BONDS
Vote FOR or AGAINST the issuance of bonds to finance an Imax
Format Motion Picture Theater Project and the levy of a sales and
use tax for the purpose of retiring these and other bonds approved
by the voters. The Imax Format Motion Picture Theater Project
consists of acquiring a site (if necessary), constructing and
equipping an Imax Format Motion Picture Theater (a theater using an
exceptionally large screen and extremely high fidelity sound to
create a sensation of movement and involvement for the viewer), and
providing some parking for users of the theater. The Imax Format
Theater is to be operated to enhance the program of the Arkansas
Museum of Science and History.
FOR the issuance of bonds in the maximum principal amount of
$4,050,000 for the purpose of financing the Imax Format Motion
Picture Theater Project and the levy of a one -half of one percent
(0.5 %) sales and use tax within the City of Little Rock for the
purpose of retiring these bonds and such other bonds as are
approved in this election and issued .........................=
AGAINST the issuance of bonds in the maximum principal amount
of $4,050,000 for the purpose of financing the Imax Format Motion
Picture Theater Project and the levy of a one -half of one percent
(0.5$) sales and use tax within the City of Little Rock for the
purpose of retiring these bonds and such other bonds as are
approved in this election and issued .........................=
The bonds which are approved and issued will be combined into
a single issue of bonds, which may be issued at one time or in
series from time to time. A local sales and use tax of one -half of
one percent (0.5%) shall be levied and pledged to the retirement of
the bonds approved and issued. The tax for retirement of the bonds
shall be collected in addition to the one -half of one percent
(0.5 %) sales and use tax for general purposes if the tax for
general purposes is approved in this election.
SECTION THREE. That Ordinance No. 16,060 of the City of Little
Rock, as herein amended, shall continue in full force and effect.
SECTION FOUR. The ability of the City to address capital
programs needed to enhance and provide for jobs and economic growth
and otherwise provide for the health, safety and welfare of the
community is in jeopardy without additional funds. It is necessary
that the amendments provided for herein be effective immediately in
order to enable the Election Commission of Pulaski County to

proceed with preparations for the bond election on October 8, 1991.
An emergency is therefore declared to exist and this Ordinance
shall be in full force and effect from and after the date of its
passage.
