3 AN ORDINANCE AMENDING CHAPTER 28 OF THE LITTLE
4 ROCK CODE OF ORDINANCES TO PROVIDE FOR CHARGES
ASSESSED BY THE ARKANSAS DEPARTMENT OF
5 POLLUTION CONTROL AND ECOLOGY FOR DUMPING IN
6 THE SANITARY LANDFILL.

8 WHEREAS, The Arkansas Department of Pollution Control and
9 Ecology has levied surcharges for the dumping of waste materials in
10 sanitary landfills and has substantially increased those surcharges
11 in 1991; and
12 WHEREAS, those surcharges are a burden upon the City's budget
13 unless they are passed on to the users of its sanitary landfill.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF

THE CITY OF LITTLE ROCK, ARKANSAS:

17 SECTION 1. Little Rock Code of Ordinances Chapter 28 is
18 hereby amended to add Section 28 -9 to read as follows:
19 The Arkansas Department of Pollution Control
20 and Ecology has levied a surcharge for the
21 dumping of waste materials in sanitary
22 landfills, and the amount of the surcharge may
23 be increased from time to time. These
24 surcharges shall be added to the fees and
25 charges otherwise assessed for disposal of
26 waste at the Little Rock Sanitary Landfill in
27 accordance with Section 28 -8. The City
28 Manager shall establish such appropriate
29 procedures as may be required to assess and
30 collect these surcharges and to remit them to
31 the State.

SECTION 2, A significant increase in the amount of the
33
surcharges levied by the Arkansas Department of Pollution Control
34 and Ecology will be effective on July 16, 1991, which was not
35 budgeted by the City, and which could inhibit the City's ability to
36
operate its sanitary landfill and provide for the health, safety

and welfare of the community without recovering these surcharges
from the users of the landfill. An emergency is therefore declared
to exist, and this ordinance shall be in full force and effect from
and after the date of its passage.
