162991 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ORDINANCE NO. 16,299 • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXTEND THE CONTRACT WITH THE MEHLBURGER FIRM OF LITTLE ROCK FOR ENGINEERING SERVICES FOR DESIGNING A NEW CITY LANDFILL AND APPROPRIATING FUNDS, DECLARING AN EMERGENCY. 611 WHEREAS, a contract with the Mehlburger Firm of Little Rock was authorized in Resolution No. 8,401 for engineering services for closing the existing City landfill; and WHEREAS, a contract with the Mehlburger Firm of Little Rock was authorized in Resolution No. 8,411 for multi -phase services including existing landfill closure, and new landfill siting and development; and WHEREAS, an extension of a contract with the Mehlburger Firm of Little Rock was authorized in Ordinance No. 16,132; and WHEREAS, the Budget Ordinance of the City of Little Rock, Arkansas for 1990, Ordinance No. 15,783, included a $150,000 appropriation for mandated improvements to the existing City landfill in preparation for its closure; and WHEREAS, the City has proceeded with its plan to close the existing landfill and acquire, construct and equip a new landfill facility (the "Project "), and has filed a permit application for the new landfill with the Arkansas Department of Pollution Control and Ecology; and WHEREAS, the City intends to obtain funds to accomplish the Project from the proceeds of revenue bonds, and has declared the City's "official intent" for the issuance of the bonds within the meaning of the applicable income tax regulations promulgated by the United States Treasury Department in Ordinance No. 16,132. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: (3-166 C -6 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 • • 612 SECTION 1. The City Manager is hereby authorized to extend the present contract with the Mehlburger Firm of Little Rock, in an amount not to exceed $823,000 for engineering services related to the preliminary design phase of the Project (the "Engineering Costs "). SECTION 2. There is hereby appropriated from the Special Project Fund balance the sum of $823,000 to fund this contract from account number 210 - 220 -0137, the Landfill Special Project. SECTION 3. That the City hereby expresses its intent to advance its own funds as described above to pay such Engineering Costs for the Project and to reimburse itself from bond proceeds for such expenditures as may be paid by the City prior to the issuance of the bonds. Debt service on the bonds will be paid from revenues from users of the Project, and other contract payments with respect to the Project. The interest on the bonds shall be exempt from federal income taxation. SECTION 4. That a copy of this Ordinance shall be filed in the official records of the City in the office of the City Clerk within ten (10) days from the passage thereof. It shall be continuously available for public inspection during regular business hours on every business day until the date of issuance of the Bonds. SECTION 5. It is hereby declared that an emergency exist, and this ordinance being necessary for the preservation of the public welfare, peace, health and safety, shall take effect and be in force from and after the date of its passage.
