19156I 2 ORDINANCE NO. 19,156 3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDDING; TO 4 ENTER INTO AN AGREEMENT WITH CITY YEAR; TO RATIFY ANY 5 PRIOR ACTIONS AND PAYMENTS; AND FOR OTHER PURPOSES. 6 7 WHEREAS, the City concluded that it would be appropriate to participate in City Year 8 during the 2004 fiscal year and to that end set aside monies in the 2004 Annual Budget for such 9 a program, and 10 WHEREAS, City Year is an "action tank" for national service which sends a diverse group 11 of young people into a community for a year of rigorous community service, leadership 12 development, and civic engagement, and 13 WHEREAS, the structure of this program is unique and the City could not participate in a 14 similar program that has the same mission and structure, thus making it impractical and 15 unfeasible to bid for a contract with such an organization, 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 17 CITY OF LITTLE ROCK, ARKANSAS: 18 Section 1. The City Manager is authorized to enter into an agreement with City Year, in 19 an amount not to exceed sixty thousand dollars ($60,000.00) to establish a City Year program in 20 Little Rock, Arkansas. 21 Section 2. The Board of Directors has determined that it is impractical and unfeasible to 22 submit this contract to competitive bidding since the City Year program, established in 1988, 23 and currently in operation in cities such as Boston, Massachusetts, Chicago, Illinois, Columbia, 24 South Carolina, San Antonio, Texas, and others, is unique in its mission and the program that it 25 provides. 26 Section 3. The Board notes that the funds for participation in City Year were included in 27 the 2004 budget, but to the extent that any actions have been taken to finalize an agreement [PAGE 1 OF 2] ORDINANCE Approval of City Year contract and dispensing with Competitive bidding 1 with City Year prior to the passage of this ordinance, such actions are hereby ratified as if 2 approved by ordinance at the time. 3 Section 4. Funds for this agreement are available in Account No. 4 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, 5 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 6 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 7 remain in full force and effect as if the portion so declared or adjudged invalid or 8 unconstitutional was not originally a part of the ordinance. 9 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent 10 with this ordinance, particularly including by not limited to Little Rock, Ark., Ordinance No. 11 18,929 (September 2, 2003), are hereby repealed to the extent of such inconsistency. 12 Section 7. Emergency.
