AN ORDINANCE PROVIDING FOR A

DEFERRAL OF SIDEWALK IMPROVEMENTS

REQUIRED BY CHAPTER 31 OF THE CODE

OF ORDINANCES OF THE CITY OF LITTLE

ROCK, ARKANSAS, AS APPLIED TO LOTS 3

AND 4 UNIVERSITY COMMERCIAL

SUBDIVISION.

WHEREAS, the current owner of Lots 3 and 4 of University
11
Commercial Subdivision has applied for a building permit on the
12
lots to construct facilities for a drive -in bank.
13
WHEREAS, the City does not deem it necessary at the
14
present time for the owner to provide sidewalk improvements to
15
the lot area; and
16
WHEREAS, future development of the lots or requirements of
17
federal law will require the imposition of sidewalk improvements
18
on the owner.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
20
OF THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. That the construction of sidewalk improvements
22
under Little Rock Code Section 31 -402 are hereby deferred as
23
applied to Lots 3 and 4 of the University Commercial
24
Subdivision.

SECTION 2. That the owner shall be required to construct
26
sidewalk improvements pursuant to ordinance standards at such
27
time in the future as the City deems necessary when the lots are
28
further developed, when expansion of the current buildings
29
necessitates the imposition of sidewalk improvements, or as
30
required by the City for compliance with federal law.

SECTION 3. This ordinance shall be filed in the deed
32
records of the Pulaski County Circuit Clerk.
33
SECTION 4. This ordinance shall take effect thirty (30)
34
days from and after its passage.
