16208� r ■w = r= M= M r= w w 0 0 252 D - i�7 /k- Io 1 ORDINANCE NO. 16,208 2 3 AN ORDINANCE TO AMEND ORDINANCE NO. _ 4 16,137 (THE 1992 BUDGET ORDINANCE u v 5 APPROPRIATING FUNDS FOR CERTAIN z 6 EXPENDITURES; AND AUTHORIZING THE CITY W U 7 MANAGER TO ACCEPT BIDS AND AWARD A 0 8 CONTRACT FOR UNDERGROUND FUEL STORAGE c r 9 TANK REMOVAL AT 7TH AND BROADWAY. u 10 11 WHEREAS, the Board of Directors of the City of Little Rock, w 12 Arkansas, adopted the Budget Ordinance of the City of Little Rock, ro H 13 Arkansas, for 1992 on December 17, 1991; and v 14 WHEREAS, the 1992 Budget Ordinance has been amended by 15 Ordinances No. 16,152, 16,179 and 16,180; and 16 WHEREAS, additional funds are now projected to become 17 available from various revenue sources. 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 19 THE CITY OF LITTLE ROCK, ARKANSAS: 20 SECTION 1: The organizational totals of the 1992 capital 21 budget included in Little Rock, Arkansas, Ordinance No. 16,137 22 (December 17, 1991) (°LRO"), and funded by Section 4 of the 23 Ordinance, as amended by Ordinance No. 16,180, is hereby amended 24 to add the following eighty thousand dollars ($80,000) in 25 appropriations: 26 Underground Fuel Storage Tanks Compliance $ 80,000 27 TOTAL $2,642,000 28 29 SECTION 2: The City Manager is authorized to accept bids 30 and award a contract to RMI, Inc., in an amount not to exceed 31 $13,410 for the removal of an underground tank and the removal of 32 contaminated water from two tanks located at 7th and Broadway. 33 (a) In the event the City is required to perform 34 additional site remediation at the direction of the Arkansas 35 Department of Pollution Control & Ecology ("ADCPE°), the City 36 D - i�7 /k- Io 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 253 Manager is authorized to increase this contract award to pay for such remediation in accordance with the unit prices bid by RMI, Inc. (b) It is not uncommon for ADPCE to make demands for additional site remediation for projects such as that covered by this ordinance. Although the City has made its best efforts to determine that actual scope of this project, it is possible that additional work will be required. Such additional work must be done at the time that the current contract is being performed and, therefore, it is impractical and unfeasible to bid such additional work. This Section, therefore serves as a waiver of the need for competitive bidding for such additional remediation work demanded by ADPCE. SECTION 3: All provisions of LRO 16,137 inconsistent with this provision are hereby repealed to the extent of such inconsistency; all other provisions of the ordinance as amended, shall remain in full force and effect.
