AN ORDINANCE AMENDING CHAPTER 8 OF THE LITTLE ROCK CODE OF
ORDINANCES, PROVIDING FOR THE ADOPTION BY REFERENCE OF THE 2003
ARKANSAS MECHANICAL CODE WITH ARKANSAS AMENDMENTS AND 2003
REVISIONS, AND FOR OTHER PURPOSES.
WHEREAS, Little Rock, Arkansas Rev. Code 8 -21(1) and 8- 474(C) adopts by reference
the 2003 edition of the "Arkansas Mechanical Code" with Arkansas Amendments and 2003
Revisions and Appendice "A" published by the International Code Council, Falls Church,
Virginia; and
WHEREAS, new amended 2003 editions of these Codes have been published by the
International Code Council and adopted by the State of Arkansas as the Arkansas Mechanical
Code, 2003 Edition; and
WHEREAS, the City has complied with Arkansas Code Ann. 14 -55- 207(1987) by
publishing a notice of intent to adopt these technical codes by reference in a paper of general
circulation within the municipality and three copies of codes have been available for inspection
in the City Clerk's office for the public prior to their adoption; and
WHEREAS, this Ordinance amendment is necessary to update the City Code and
authorize the use of the 2003 edition within the City.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. 8 -2 of Little Rock, Arkansas Rev. Code is hereby amended to read as
follows:
(1) The "2003 Arkansas Mechanical Code" with Arkansas Amendments and 2003
Revisions with Appendice "A ".
SECTION 2. 8 -474 of Little Rock, Arkansas Rev. Code is hereby amended to read as
follows:
(C) The "2003 Arkansas Mechanical Code with Arkansas Amendments and 2003
Revisions and Appendice "A" is adopted by reference.
(D) In the event of a conflict between the publications in subsections (A), (B) or (C),
the more stringent provisions shall govern.
(E) Notwithstanding the provisions of Sections (A), (B), and (C) above, the City,
consistent with other provisions of state law, shall set the job qualification for its
employees. No job qualifications contained in the 2003 Arkansas Mechanical
Code are adopted in any form whatsoever.
SECTION 3. All ordinances or parts of ordinances in conflict with this provision are
hereby repealed to the extent of the conflict.
