AN ORDINANCE TO WAIVE THE FILING FEE AND
REFILING PROVISION FOR EXISTING USES WITHIN
EXTRATERRITORIAL AREA 2 FOR A PERIOD OF SIX
MONTHS TO END AUGUST 14, 1992.
WHEREAS, the City of Little Rock has brought forth
rezoning requests within the extraterritorial Area 2 at no charge
to the property owners; and,
WHEREAS, the City of Little Rock Staff in addition to
legal advertisement notified one -third to one -half of all the
Area 2 residents and property owners by means of mail notice;
and,
WHEREAS, the City of Little Rock wishes to assure that if
an individual did not know of this rezoning action, they would
still have the opportunity to file; and,
WHEREAS, the Little Rock Planning Commission recommends
the waiver of fees and restrictions on refiling a request.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK.
SECTION 1. That the Little Rock Board of Directors grants a
six month grace period, during which time, any property owner may
submit a request for rezoning without being assessed a filing
fee. This has the effect of waiving Ordinance 15,776 until
August 14, 1992 for all properties south of Kanis and west of the
city limits within the City Planning area.
SECTION 2. That the Little Rock Board of Directors waives
the restriction on refiling zoning requests (Ordinance No. 36 -83)
within a one year time period for the area west of the city
limits and south of Kanis Road until August 14, 1992.
SECTION 3. This waiver does not relieve the property owner
of the requirement to notify adjacent property owners.
SECTION 4. This grace period shall include any property
owner within the Area 2, notwithstanding any previous actions by
the City of Little Rock Board of Directors, Planning Commission
or Staff.
