AN ORDINANCE TO AMEND LITTLE ROCK,

ARK., ORDINANCE 13,790 (JUNE 16,

1981), AS ANENDED, TO INCREASE THE
6
FRANCHISE FEE FOR CABLE TELEVISION
7
SERVICES WITHIN THE CITY OF LITTLE
8
ROCK; DECLARING AN EMERGENCY; AND

FOR OTHER PURPOSES.

WHEREAS. the Cable Communications Policy Act of 1984 and
the Cable Consumers Protection Act of 1992 permit a franchise
13
fee of five percent (5 %) to be assessed against cable operators
14
pursuant to federal law; and
15
WHEREAS, the City of Little Rock presently has a three
16
percent (3 %) franchise fee.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
18
THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The first sentence of Paragraph 9(a) of page 18
20
of the franchise agreement attached to and incorporated as a
21
part of Little Rock, Ark., Ordinance No. 13,790 (June 16, 1981),
22
is hereby amended to read as follows:

a. The grantee shall pay to the City in consideration for
24
the granting of the Franchise to use the public ways for the
25
operation of a Cable Television System, five percent (5%) of its
26
annual gross revenues during the period of its operation under
27
the franchise.

SECTION 2. EMERGENCY CLAUSE. Because the franchise
29
ordinance establishing this fee needs to be effective on January
30
1, 1994, in order to provide the funds necessary to protect
31
rights -of -way and fulfill other purposes necessary to the public
32
health, safety and welfare and because less than thirty (30)
33
days remain before that date, an emergency is declared to exist
34
and this ordinance shall be in full force and effect on January
35
1, 1994.
