ORDINANCE 16,059; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. 611 WHEREAS, the City of Little Rock passed an ordinance on June 18, 1991, to permit the assessment of a $5.00 indigent court cost in the Little Rock Municipal Courts; and WHEREAS, this cost was forwarded to Pulaski County to help pay the cost of the County Public Defenders Office; and WHEREAS, the legislature has passed Act 1193 of 1993 which mandates the collection of a $5.00 indigent defense court cost and gives counties the authority to collect an additional $5.00 court cost, which the county has exercised through Pul. Co. Ord. 93-OR -66; and WHEREAS, the City must remit indigent court costs pursuant to the current law, Act 1193 of 1993: NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Little Rock, Ark. Ordinance 16,059 (June 18, 1991) is hereby repealed. SECTION 2. Emergency. Payment of appointed counsel is necessary for the proper adjudication of offenses and actions in the municipal court, and for the constitutional operation of the municipal courts. Therefore, an emergency is hereby declared to exist and this ordinance being immediately necessary for the preservation of the public peace, health and safety shall be in full force and effect from and after its passage and approval.
