164970 1 ORDINANCE NO. 16,497 F c 2 AN ORDINANCE PURSUANT TO ARK. CODE 5 6 3 ANN. § 14- 164 -338 LEVYING A 4 ONE- PERCENT (1%) SALES AND USE TAX 5 FOR A PERIOD OF TWENTY -FOUR (24) 6 MONTHS TO MAKE CERTAIN CAPITAL 7 IMPROVEMENTS; CALLING A SPECIAL ELECTION TO APPROVE SUCH A LEVY; 8 AND FOR OTHER PURPOSES. 9 10 WHEREAS, the Board of Directors of the City of Little Rock, 11 Arkansas has adopted the findings of the Future Little Rock 12 Committee that the City has immediate need for certain Capital Improvements, and 13 WHEREAS, Arkansas Code Annotated § 14- 164 -338 authorizes a 14 1% sales and use tax for up to twenty -four months to finance 15 said improvements; and 16 WHEREAS, the voters of the City of Little Rock should be 17 asked to approve such tax at a special election. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 18 THE CITY OF LITTLE ROCK, ARKANSAS: 19 SECTION 1. There is hereby levied a one percent (1 %) sales 20 and use tax to be collected for twenty -four months contingent on 21 approval by the voters at a special election. 22 SECTION 2. That there be, and there is hereby called, a special election to be held on December 14, 1993, at which 23 election there shall be submitted to the electors of the City of 24 Little Rock, Arkansas, the question of levying for a period of 25 twenty -four months, a citywide one percent (1 %) sales and use 26 tax under Arkansas Code Annotated § 14- 164 -338 to finance the 27 costs of purchasing sites for constructing and equipping the following public facilities: (a) A 16,000 seat events 28 center /arena, (b) a West Little Rock recreational facility, (c) 29 improvements to the Riverfront Park Amphitheater, (d) a 30 Community Center swimming pool in Southwest Little Rock, (e) to 31 improve roads and drainage, and (f) to expand and modernize the 32 Central Arkansas Transit Authority bus fleet, as more fully explained in Exhibit A. 33 SECTION 3. That the question of levying the sales and use 34 tax shall be placed on the ballot for the election in 35 substantially the following form: 36 069 a'7 0 0 A proposal to levy a citywide one percent (1 %) sales and 1 use tax to purchase sites for, construct, and equip the 63 2 following public facilities in the City of Little Rock. The tax shall be collected for twenty -four (24) months, beginning 3 February 1, 1994, and shall cease to be levied on February 1, 4 1996. The revenues derived from this sales and use tax shall be 5 used only for the stated purpose. 6 [ ] For adoption of a twenty -four month one 7 percent (1 %) sales and use tax within the City of Little Rock for capital improvements for 8 (a) A 16,000 seat events center /arena, (b) a 9 West Little Rock recreational facility, (c) 10 improvements to the Riverfront Park 11 Amphitheater, (d) a Community Center swimming 12 pool in Southwest Little Rock, (e) to improve roads and drainage, and (f) to expand and 13 modernize the Central Arkansas Transit 14 Authority bus fleet, as more fully explained 15 in Exhibit A. 16 17 [ ] Against adoption of a twenty -four month one percent (1%) sales and use tax within the City 18 of Little Rock capital improvements for (a) A 19 16,000 seat events center /arena, (b) a West 20 Little Rock recreational facility, (c) 21 improvements to the Riverfront Park 22 Amphitheater, (d) a Community Center swimming pool in Southwest Little Rock, (e) to improve 23 roads and drainage, and (f) to expand and 24 modernize the Central Arkansas Transit 25 Authority bus fleet, as more fully explained 26 27 SECTION 4. (a) This municipal 1% sales and use tax shall be levied and collected only on the first two thousand five hundred 28 dollars ($2,500) of gross receipts, gross proceeds or sales 29 price from each single transaction as provided in Ark. Code Ann. 30 § 26 -75 -222 as amended by Act 1014 of 1993. 31 (b) "Single transaction" is defined as 32 SECTION 5. That the election shall be held and conducted in the manner now provided for such elections in Ark. Code Ann. § 33 14- 164 -301 et seq. 34 SECTION 6. That the Mayor and City Clerk for and on behalf 35 of the City are hereby directed to do all things necessary to 36 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 0 9 call and hold the special election and to perform all acts necessary to carry out the intent of this ordinance. SECTION 7. That the funds collected pursuant to this c a ordinance shall be appropriated by the Board of Directors and U used solely for the purposes expressed in this ordinance. SECTION 8. SEVERABILITY: If any part of this Ordinance is held invalid such invalidity shall not affect any other portion of this Ordinance. SECTION 9. REPEALER: That all ordinances and parts thereof in conflict herewith are hereby repealed to the intent of such conflict. SECTION 10. EMERGENCY CLAUSE. It is hereby found and determined by the Board of Directors of the City of Little Rock that there is an immediate and pressing need to finance capital improvements for the City without incurring unnecessary bond issue expenses; that this ordinance is necessary to provide for an election on the issue of levying a sales and use tax without issuing bonds; that this ordinance should be given effect immediately in order to provide for a timely election and thereby minimize financing costs. Therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall be in full force and effect from and after its passage and approval.
