164880 544 2 ORDINANCE NO. 16,488 3 4 AN ORDINANCE AMENDING SECTION 17 -100 5 OF THE LITTLE ROCK CITY CODE (1988) 6 FOR THE PURPOSE OF REALIGNING THE 7 MEMBERSHIP OF THE ADVERTISING AND 8 PROMOTION COMMISSION IN ORDER TO 9 COMPLY WITH ACT 364 OF 1993; 10 DECLARING AN EMERGENCY; AND FOR 11 OTHER PURPOSES. 12 13 WHEREAS, the Board of Directors of the City of Little Rock, 14 Arkansas, owns convention facilities. including generally 15 Robinson Auditorium, a parking garage, and the Statehouse 16 Convention Center which are operated by the Little Rock 17 Advertising and Promotion Commission pursuant to Little Rock, 18 Ark. Rev. Code Section 17- 100(a) (1988) and the Advertising and 19 Promotion Commission Act, Ark. Code Ann. §§ 26 -75 -601 -618 20 (Michie Supp. 1991); and 21 WHEREAS, Act 364 of 1993 amended the Act to change the 22 membership of the Advertising and Promotion Commission; and 23 WHEREAS, changes in Little Rock, Ark. Rev. Code § 17 -100 24 (1988) are necessary in order to comply with said amendment. 25 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF 26 THE CITY OF LITTLE ROCK, ARKANSAS: 27 SECTION 1. Subsection A of Little Rock, Ark. Rev. Code § 28 17 -100 (1988) is hereby amended as follows: 29 (a) There is hereby created the City Advertising and 30 Promotion Commission. The Commission shall have the powers and 31 duties prescribed by the Advertising and Promotion Commission 32 Act, Ark. Code Ann. §§ 26 -75 -601 -618 (Michie Supp. 1991) as now 33 or hereafter amended. The Commission shall be composed of seven 34 (7) members, each of whom shall reside within the City, as 35 follows: 36 4)(,7 6y 1• Four (4) members shall be owners or 545 1 managers of businesses in the tourism 2 industry, at least three (3) shall be owners 3 or managers of hotels, motels, or restaurants, 4 and shall serve for staggered terms of four 5 (4) years; and 6 2. Two (2) members shall be members of 7 the Board of Directors of the City and 8 selected by the Board and shall serve at the 9 will of the Board; and 10 (3) One (1) member shall be from the 11 public at -large and shall serve for a term of 12 four (4) years. 13 (b) Vacancies on the Commission, whether resulting from 14 expiration of a regular term or otherwise, in any of the four 15 (4) tourism positions provided for in (a)(1) or in the at -large 16 position provided for in (a)(3) shall be filled by appointment 17 made by the remaining members of the Commission with the 18 approval of the Board. 19 (c) The Commission is subject to all fiscal procedures of 20 the City. 21 SECTION 2. The present members of the Commission shall 22 continue in office for the balance of the terms to which they 23 have been previously appointed; provided, however, that the 24 Mayor shall designate one of the present members of the 25 Commission who is also a member of the Board to fill the 26 at -large position provided for in Subsection(a)(3) above for the 27 term to expire May 1, 1994. 28 SECTION 3. No part of this ordinance is intended, nor shall 29 it be construed, to amend or repeal any part or provision of 30 Little Rock, Ark. Rev. Code S 17 -96 -100 (1988) other than 31 Subsection (a) thereof. All other ordinances and resolutions and 32 parts thereof in conflict in whole or in part with any of the 33 provisions of this ordinance are hereby repealed to the extent 34 of such conflict. 35 SECTION 4. If any provision shall be held to be invalid or to be inapplicable to any person or circumstances, such invalidity or inapplicability shall not affect the remainder of the provisions of this ordinance. SECTION 5. EMERGENCY. The Board hereby determines that changes to the membership of the Commission are necessary to comply with Act 364 of 1993; and that this ordinance shall be given immediate effect so that the operation of the Convention Facilities may continue uninterrupted. Therefore, an emergency is hereby declared to exist and this ordinance, being necessary for the immediate preservation of the public health, safety, and welfare, shall be in full force and effect from and after its passage and approval.
