3 AN ORDINANCE DISPENSING WITH THE

REQUIREMENT OF COMPETITIVE BIDDING AND
5
6 AUTHORIZING THE CITY MANAGER TO ENTER
7 INTO A CONTRACT WITH SUPERIOR TECH, INC.
8 FOR THE PURCHASE OF DEBAGGING UNITS FOR
9 THE PUBLIC WORKS DEPARTMENT.

WHEREAS, the Board of Directors may dispense with the
12
13 requirement of competitive bidding in exceptional situations where
14 such procedure is not feasible; and
15 WHEREAS, the debagging units will be used to increase the
16 effectiveness of the City's yard waste collection; and
17 WHEREAS, separation of yard waste is mandated by Arkansas
18
Act 751 effective July 1, 1993.

20 WHEREAS, the Purchasing Division of the Finance Department
21 solicited bids for similar equipment in December of 1992 and it
22 was determined at that time that the equipment was a sole source
23 acquisition.
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
25 THE CITY OF LITTLE ROCK, ARKANSAS:

SECTION 1. The Board of Directors of the City of Little
27
28 Rock finds that competitive bidding should be dispensed with for
29 the purchase of debagging units as an exceptional situation exists
30 and competitive bidding is not feasible.
31 SECTION 2. The City Manager is authorized to enter into a
32 contract with Superior Tech, Inc. in an amount not to exceed
33
$33,987.50 for the purchase of ten debagging units for the Public
34
35 Works Department.
