AN ORDINANCE GRANTING A CONDITIONAL FRANCHISE
TO MINNESOTA MINING AND MANUFACTURING COMPANY
TO OCCUPY A PART OF THE PUBLIC OWNED
RIGHT -OF -WAY OF 40TH STREET IN GRANITE PARR
ADDITION TO THE CITY OF LITTLE ROCK, BETWEEN
THE EAST BOUNDARY LINE OF OHIO AVENUE AND THE
WEST BOUNDARY LINE OF ATHENS AVENUE FOR THE
PURPOSE OF INSTALLING A PRIVATE SEWER LINE;
PROVIDING FOR REVERSION OF THE FRANCHISE TO THE
CITY WHEN NO LONGER REQUIRED BY MINNESOTA
]XINING AND MANUFACTURING COMPANY FOR USE AS A
SEWER LINE; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, THAT:
SECTION 1: Minnesota Mining and Manufacturing Company
(03M °) is hereby granted a conditional franchise lying in
Section 13, Township 1 North, Range 12 West in the City of
Little Rock, Pulaski County, Arkansas, more particularly.
described as follows:
The franchise shall consist of 10 feet on either
side of a line described as beginning at a point on
the West Right -of -Way Line of Athens Avenue in Granite
Park Addition, said point being 15 feet North of the
South Right -of -Way Line of 40th Street, thence South
89 0021530 East 1360.649 feet to a Point on the East
Right -of -Way Line of Ohio Avenue.
And also, a temporary construction area consisting of a
strip of land 40 feet in width, the South Line of which is 15
feet South of the above described line and the North Line of
which is 25 feet North of the above described line, the
construction area being for use during the initial sewer line
construction only. Said sewer line will be buried a minimum of
36 inches below grade level.

SECTION 2: This grant is conditioned upon its immediate
reversion to the City when the land is no longer required by 3M
for its use of the sewer line. In such event 3M shall, at its
own cost and expense, remove from said premises its property and
said facilities and shall thereupon surrender and deliver
possession of said premises to the City of Little Rock.
SECTION 3: This grant is further conditioned upon 3M
indemnifying and holding the City harmless for any and all
liability for damages, costs, losses and expenses for all
injuries or death and all damage to any and all property, by
whomsoever owned, resulting from, arising out of, or in any way
connected with 3M's use of the franchised premises for the
aforesaid purposes.
SECTION 4: This grant is conditioned upon compliance with
the City's Utility Relocation Policy, Little Rock Resolution No.
7,487 (October 15, 1985).
SECTION 5: This ordinance shall be in full force and
effect from ten days after its approval.
