M 16,455 • 367 1 I 2 3 AN ORDINANCE TO AMEND ORDINANCE NO. 16,331 (THE 1993 BUDGET 4 ORDINANCE) AND ORDINANCE NO. 16,410; TO AMEND SECTION 28 -46 5 OF THE 1988 LITTLE ROCK CITY CODE OF ORDINANCES, PROVIDING 6 FOR A SCHEDULE OF GARBAGE COLLECTION FEES AS SET OUT 7 THEREIN; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. 8 9 10 WHEREAS, the Board of Directors of the City of Little Rock, Arkansas adopted the 11 12 Budget Ordinance of the City of Little Rock, Arkansas for 1993 on December 21, 1992; and 13 WHEREAS, the City of Little Rock, Arkansas owns and operates a waste collection and 14 disposal system; and 15 15 WHEREAS, the City intends to adjust collection service levels, resulting in lower costs 17 and, therefore, lower collection fees. 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE 19 CITY OF LITTLE ROCK, ARKANSAS: 20 21 SECTION 1: The organization total in the 1993 operating budget included in Schedule 22 1 to Ordinance No. 16,331 for Organization No. 2110 is amended and decreased by $132,875. 23 Further, this ordinance amends Ordinance No. 16,410 to the extent of any conflict concerning 24 rates for garbage collection fees. 25 2 5 SECTION 2: Section 28 -46 (a) (1) of the 1988 Little Rock City Code is hereby amended 27 to read as follows: 28 "For each single residence or unit of multiple dwelling utilizing City approved 29 containers serviceable by manpower, the sum of Thirteen Dollars and Seventy- 30 five cents ($13.75) per month commencing with billings due after August 1,1993; 31 such fees shall be collected monthly and billed on the statement for water for 32 said premises and be the debt and obligation of the person, firm or corporation 33 34 in whose name the water meter for said residence, or unit of multiple dwelling 35 is listed." 36 DGS F3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 368 SECTION 3: Section 28 -46 (a) (2) of the 1988 Little Rock City Code is hereby amended to read as follows: "For such commercial property utilizing City approved, privately owned containers not capable of being serviced, except by manpower, the fee will be Five Dollars and Fifty cents ($5.50) per month per cubic yard of material handled but not less than a minimum charge of Twenty-four Dollars and Twenty-five cents ($24.25) per month. Such fees shall be collected monthly and be billed on the statement for water for the premises served and be the debt and obligation of the person, firm or corporation in whose name the water meter or meters for such commercial property is listed." SECTION 4. Garbage collection is a service directly affecting the health, safety, and welfare of all citizens in the City of Little Rock. A decrease in the garbage collection fee is necessary to pass on cost savings resulting from revised collection service procedures to citizens. Therefore, an emergency is declared to exist, and this ordinance shall take effect and be in force from the date of its approval.
