16447WHEREAS, Ordinance No. 14,474, passed on July 5, 1983,
established and provided for the maintenance of a PCD entitled
"Rock Creek PCD" (Z- 4030), located at 8500 Cunningham Lake Road
in the City of Little Rock, Arkansas; and,

WHEREAS, Ordinance No. 15,607, passed on December 20, 1988,
approved and provided for the establishment of an amended PCD
District titled "Storage World Amended PCD" (Z- 5111), and changed
the zone classification of said district located at 8500
Cunningham Lake Road from "PCD" to "Amended PCD"; and,
WHEREAS, Article VII, Section 36- 454(d), Chapter 36 of the
Code of Ordinances of the City of Little Rock, Arkansas, provides
that an applicant shall have three (3) years from the date of
preliminary plan /plat approval (by the Planning Commission) to
submit the final plan /plat ", and that any "time extension must be
applied for before the time elapses or all preliminary approvals
as well as rezoning shall be invalid and cause removal of the PUD
record from the official zoning map "; and,
WHEREAS, the required approved plan /plat was not submitted
for approval within the time limit required in Section 36- 454(d)
and the approval of "Storage World Amended PCD" (Z -5111) has
consequently lapsed; and,
WHEREAS, there has been a request to reinstate the "Storage
World Amended PCD" (Z- 5111 -A) and seek a variance from the
requirement for sidewalk construction along the Cunningham Lake
Road frontage of the PCD.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That Ordinance No. 14,474 be amended to provide
for modification of the District described as "Rock Creek PCD"
(Z -4030) and hereafter designated at "Storage World Amended
Short -form PCD" (Z- 5111 -A).

SECTION 2. That the revised Site Development Plan and plat
be approved as recommended by the Little Rock Planning
Commission.
SECTION 3. That the maintenance of the zoning
classification and approval of the revised plan for Storage world
Amended Short -form PCD is conditioned upon obtaining final plan
approval within the time specified by Article VII, Section
36 -462, Chapter 36 of the Code of Ordinances and upon executing
the required quit -claim deed conveying to the City of Little Rock
the required right -of -way dedication for the Cunningham Lake Road
frontage.
SECTION 4. That the map referred to in Chapter 36 -81 and
36 -82 of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and it is hereby amended
to the extent and in the respects necessary to affect the
designated change provided for in Section 1 hereof.
SECTION S. That Chapter 31, Section 31 -209, Street
Classification and Standards, be amended to provide relief from
the requirement that a sidewalk be constructed along the boundary
street to the PCD, Cunningham Lake Road, and designated by the
Master Street Plan as a residential street, and grant a variance
to such requirement whereby the construction of the sidewalk is
waived.
SECTION 6. That this Ordinance shall take effect and be in
full force upon final approval of the plan by the Planning
Commission.
