AN ORDINANCE TO AMEND SECTION 28 -46 OF THE
1988 LITTLE ROCK CITY CODE OF ORDINANCES,
PROVIDING FOR A SCHEDULE OF GARBAGE
COLLECTION FEES AS SET OUT THEREIN;
DECLARING AN EMERGENCY; AND FOR OTHER
PURPOSES.
WHEREAS, the City of Little Rock, Arkansas owns and operates a waste
collection and disposal system; and
WHEREAS, the City intends to issue revenue bonds to finance the construction
of betterments and improvements to the system; and
WHEREAS, the City's current schedule of garbage collection fees is inadequate
to provide funds to repay the revenue bonds, and the City agreed to establish rates
adequate to repay the bonds in connection with their issuance.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1: Section 28 -46 (a) (1) of the 1988 Little Rock City Code is hereby
amended to read as follows:
"For each single residence or unit of multiple dwelling utilizing City
approved containers serviceable by manpower, the sum of Fourteen
Dollars and Twenty -five cents ($14.25) per month commencing with
billings due after April 1, 1993; such fees shall be collected monthly and
billed on the statement for water for said premises and be the debt and
obligation of the person, firm or corporation in whose name the water
meter for said residence, or unit of multiple dwelling is listed."

SECTION 2: Section 28 -46 (a) (2) of the 1988 Little Rock City Code is hereby
amended to read as follows:
"For such commercial property utilizing City approved, privately owned
containers not capable of being serviced, except by manpower, the fee will
be Five Dollars and Fifty cents ($5.50) per month per cubic yard of
material handled but not less than a minimum charge of Twenty -five
Dollars ($25.00) per month. Such fees shall be collected monthly and be
billed on the statement for water for the premises served and be the debt
and obligation of the person, firm or corporation in whose name the water
meter or meters for such commercial property is listed."
SECTION 3. The costs to operate the system improvements and dispose of
wastes in the new sanitary landfill will be greater than those presently. Accordingly,
Chapter 28 of the City Code shall be further amended to revise the schedule of waste
disposal charges when those new costs are known.
SECTION 4. Garbage collection is a service directly affecting the health, safety,
and welfare of all citizens in the City of Little Rock. An increase in the garbage
collection fee is necessary to repay the revenue bonds issued to finance system
improvements. Therefore, an emergency is declared to exist, and this ordinance shall
take effect and be in force from the date of its approval.
