3 AN ORDINANCE APPROPRIATING FUNDS
4 FROM THE GENERAL FUND TO MAKE
5 NECESSARY PAYMENTS TO EMPLOYEES THAT
MAY BE DEEMED TO HAVE BEEN
6 IMPROPERLY ASSESSED VACATION OR SICK
7 LEAVE; DECLARING AN EMERGENCY, AND
8 FOR OTHER PURPOSES.

10 WHEREAS, the City of Little Rock, as several other
governmental units within the Country, assessed all employees
it vacation or sick leave on a less than a full day basis; and
12 WHEREAS, regulations of the United States Department of
13 Labor as interpreted by certain federal courts have determined
14 that government employees exempt from overtime payments for
15 purposes of FLSA still cannot be assessed less than full day
vacation or sick leave without being deemed hourly employees;
16 and
17 WHEREAS, the City Attorney, upon reviewing this situation,
18 has determined that the appropriate action to show the good
19 faith of the City is to reinstate sick leave and vacation leave
20 to City employees; and
WHEREAS, certain employees within the requisite time period
21 of September 11, 1989, to September 11, 1992, have ended
22 employment with the City; and
23 WHEREAS, upon such end of employment persons are eligible
24 for payment of accrued vacation leave and certain persons are
25 entitled to payment into the pension fund for accrued sick
leave, or perhaps even accrued sick leave payments; and
26 WHEREAS, the City wishes to show its good faith efforts to
27 comply with the restrictions of the FLSA and have taken steps to
28 do so, such steps including compliance with the new regulations
29 which were issued in September, 1992.
30 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
31 SECTION 1. The sum of $22,606.26 is hereby appropriated
32 from the City's general fund to make reimbursement payments for
33 accrued vacation leave to otherwise exempt employees of the City
34 of Little Rock for the period September 11, 1989, to September
35 11, 1992, who were assessed less than full day sick or vacation
leave as evidenced in attached Exhibit "A ".

SECTION 2. EMERGENCY. The compliance with federal labor
laws concerning overtime payments or vacation and sick leave
requirements for exempt employees is an essential operating
function of the City and is necessary to preserve the health,
safety and welfare of the citizens of the City. To show the good
faith of the City of Little Rock in making this accommodation,
an emergency is declared to exist and this ordinance shall be in
full force and effect from and after the date of its adoption.
