15256I ORDINANCE NO. 15,256 89 2 AN ORDINANCE AMENDING ORDINANCE NO. 11,317 3 SECTION 1 OF 1962 CODIFIED AS SECTION 21-14(c) 4 OF THE LITTLE ROCK, ARKANSAS, CODE OF ORDINANCES, PROVIDING AN EXCEPTION TO THE DEFINITION OF DEALER 5 IN SECONDHAND GOODS; AND DECLARING AN EMERGENCY. 6 BE.IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF 7 LITTLE ROCK, ARKANSAS: 8 SECTION 1. Section 1 of Ordinance No. 11,317 of 1962, 9 codified as Section 21-14(c) of the Little Rock, Arkansas, Code 10 of Ordinances is hereby amended to read: 11 (c) Dealer in Secondhand Goods: Any person, 12 firm or corporation buying, selling or 13 otherwise dealing principally in used or 14 secondhand goods, and any person, firm or 15 corporation who buys for resale any used or 16 secondhand goods, whether or not as a 17 principal vocation.or business, and without 18 regard to whether or not such person, firm or 19 corporation maintains a place of business for 20 such purpose. This definition shall not 21 include a licensed retailer of new goods who 22 shall, in the ordinary course of business, 23 receive used or secondhand goods only as a 24 "trade -in" or as part consideration for 25 purchases of new goods. Further, this 26 definition shall not include a person who 27 sells or exchanges coins, tokens, metals, or 28 goods of any other nature, if such activity 29 is conducted as part of an approved exhibit 30 at an approved convention held in a facility 31 subject to the regulation of the Little Rock 32 Advertising and Promotion Commission. 33 SECTION 2. Emergency Clause. The ability to attract 34 conventions to the City of Little Rock that involve the buying or 35 selling of goods is jeopardized by the inability of the City to 36 assure that these dealers will not be subject to the secondhand U-11 w w w w w w w w w w w w w w �■ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 goods ordinance of the City of Little Rock. The Board of Directors is aware that the American Numismatic Association may withdraw its convention bid to the City if modification of the present ordinances is not made within the immediate future. The Board is further aware that other conventions will not consider the City of Little Rock if these amendments are not offered. Since the booking of conventions into the Bureau must take place several months in advance, and since the failure to approve this ordinance immediately and make it effective immediately could mean the loss of revenue, prestige, taxes, and convention monies to the citizens of the City of Little Rock and jeopardize the functions that have been properly delegated by statute and ordinance to the Little Rock Advertising and Promotion Commission, the Board of Directors declares that an emergency exists and upon passage this ordinance must be made effective immediately.
