ORDINANCE NO. 15,248 70
AN ORDINANCE WAIVING THE REQUIREMENTS OF
COMPETITIVE BIDDING FOR REPAIRS OF A SEWER
LINE SITUATED AT THE LITTLE ROCK MUNICIPAL
AIRPORT; DECLARING AN EMERGENCY, AND FOR
OTHER PURPOSES
WHEREAS, a portion of the sewer system owned by the City of
Little Rock is situated on property occupied by the Little Rock
Municipal Airport, as shown on the attached map, and the line in
this area is in need of immediate repairs to prevent further
deterioration of the line and
WHEREAS, the Sanitary Sewer Committee of Little Rock is
retaining a consulting engineer to supervise the repairs and it is
anticipated that the recommendation of the consulting engineer
will be that the repairs should be made as promptly and as
expeditiously as possible without competitive bidding which would
serve no useful purpose but, on the contrary, would delay the
expeditious repair to the detriment of the public health and
welfare; and
WHEREAS, the Sanitary Sewer Committee of the City of Little
Rock has on February 10, 1987 declared a state of emergency
regarding the condition of this sewer line and has further
instructed the Manager of the Little Rock Wastewater Utility to
initiate action to accomplish the repairs on this sewer line as
soon as reasonably and economically possible; and
WHEREAS, pursuant to Ark. Stat. Ann. 19 -4425 and City
Ordinance of Little Rock 2 -44, 'the Board of Directors, by
Ordinance, may waive the requirement of competitive bidding in
exceptional situations where such procedure is not feasible, and
the necessity for immediate repair to the sewer line on the Little
Rock Municipal Airport property constitutes such an exceptional
situation because competitive bidding would serve no useful
purpose, but on the contrary would cause further delay in making
the repairs and a greater cost due to delay.
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of
the City of Little Rock, Arkansas:
Section 1. That the condition of the sewer line situated on
the property occupied by the Little Rock Municipal Airport, is in
immediate need of repairs and competitive bidding for the purpose
of entering into agreements with consultants and appropriate
repair specialty firms to perform the repairs would serve no
useful purpose, the Sanitary Sewer Committee and the Manager of
the Little Rock Wastewater Utility are hereby authorized to
proceed forthwith to employ responsible firms to perform all
re--)airs incidental to or related to the sewer line and the
requirement of competitive bidding is hereby waived.

Section 2. That since the repairs to the sewer line on the
Little Rock Municipal Airport property are immediately necessary
and the authorization extended to the Sanitary Sewer Committee
and the Manager of the Little Rock Wastewater Utility is of great
importance to the health and welfare of the citizens of Little
Rock, an emergency is hereby declared to exist and this Ordinance
shall be in full force and effect from and after its passage and
approval.
