AN ORDINANCE AUTHORIZING THE EXPENDITURE

OF FUNDS FOR THE PURCHASE OF ADDITIONAL
6 RIGHT -OF -WAY TO UPGRADE RIDGE HAVEN ROAD
7 AND AUTHORIZING THE CITY MANAGER TO
8 ENTER INTO A CONTRACT WITH DARBE DEVELOPMENT
9 CORPORATION FOR IMPROVEMENT OF RIDGE HAVEN
10 ROAD.

12 WHEREAS, the Planning Commission has approved Scheme D
13 of the Ridge Haven Valley Subdivision subject to Ridge Haven
14 Road being upgraded; and
15 WHEREAS, property owners along Ridge Haven Road have
16 agreed to sell portions of their properties for right -of -way
17 to improve the street; and
18 WHEREAS, Ridge Haven Road is presently substandard and
19 needs to be improved; and
20 WHEREAS, the developer of Ridge Haven Valley
21 Subdivision, the Darbe Development Corporation, will be
22 expending a significant sum to perform street construction
23 work necessary to upgrade Ridge Haven Road, if the City
24 purchases the additional right -of -way that is needed; and
25 WHEREAS, the upgrading of an existing public street is
26 a public purpose.
27 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
28 DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
29 SECTION 1. An expenditure is hereby authorized from
30 the 1986 Advance Right -of -Way Account (Account No. 8692) of
31 the City of Little Rock for the purpose of acquiring
32 additional right -of -way for Ridge Haven Road at the
33 appraised market value.
34 SECTION 2. The City Manager is hereby authorized to
35 enter into an agreement with the Darbe Development
36 Corporation whereby the Darbe Development Corporation will

construct improvements to Ridge Haven Road in accordance 44
with plans approved by the City, after the City has acquired
the additional right -of -way that is needed.
SECTION 3. This ordinance shall be in full force and
effect from and after its adoption.
