AN ORDINANCE AUTHORIZING THE CITY TO CHARGE
ANY COUNTY KEEPING COUNTY PRISONERS IN THE
LITTLE ROCK DETENTION CENTER $25.00 PER DAY
FOR EACH PRISONER AND TO COLLECT ADDITIONAL
COSTS INCURRED IN THE CARE OF SUCH PRISONERS
PURSUANT TO ARK. STAT. ANN. §46 -707; AND
DECLARING AN EMERGENCY.

WHEREAS, there has been an increase in the number
of prisoners from other jurisdictions who must be held in the
Little Rock Detention Center while space is being made for those
prisoners in the other jurisdictions' jails; and
WHEREAS, the City of Little Rock must house, clothe, feed
and guard those prisoners in the-same manner.it must provide for.
its own prisoners at an average expense of $25 per diem; and
WHEREAS, the City of Little Rock must also provide
medical attention for those prisoners when they require it; and
WHEREAS, Arkansas law allows the governing body of a
municipality to establish a daily fee to be charged to counties
for keeping county prisoners in the municipal jail;and
WHEREAS, it is estimated that it has cost the taxpayers
of the City of Little Rock in excess of $461,000 to care for
county prisoners since the passage of Act No. 796 of 1981.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock shall charge any
county keeping county prisoners in the Little Rock Detention
Center a reasonable fee of $25.00 per day for each prisoner so
kept, pursuant to Ark. Stat. Ann. §46 -707.

1 SECTION 2. The City of Little Rock shall also bill the
2 county separately for any additional costs incurred in the care
3 of a county prisoner arising from medical, dental or psychiatric
4 treatment while the county prisoner is in the Little Rock
5 Detention Center.
6 SECTION 3. Declaring an Emergency. It is hereby
7 declared that there is an immediate need for the collection of a
8 reasonable fee for the keeping of county prisoners in order to
9 promote and protect the health, safety and welfare of the City of
10 Little Rock. This Ordinance shall be in full force and effect
11 immediately from and after its passage.
