AN ORDINANCE AMENDING SECTION 37.10 OF
THE SUBDIVISION ORDINANCE OF THE CITY
OF LITTLE ROCK.

WHEREAS, the Board of Directors of the City of Little Rock
has determined it necessary to revise certain language contained
in the Subdivision Ordinance for the City of Little Rock based on
a current decision by the Arkansas Supreme Court.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Section 37.10 of the Subdivision Ordinance of
the Little Rock Code of Ordinances is hereby amended to read as
follows: Delete Paragraph (a) and substitute as follows:
(a) General - The rules and regulations set forth in
this ordinance are the standard requirements of the
City. Where the applicant alleges that extraordinary
hardships or practical difficulties may result from
strict compliance with these regulations, or the
purpose of these regulations may be served to a
greater extent by an alternative proposal, the
Planning staff and the Planning Commission shall
review such requests for variances and the staff and
Commission shall forward its recommendation to the
Board of Directors for final action so that
substantial justice may be done and the public
interest secured. Such variances, however, shall not
have the effect of nullifying the intent and purpose
of these regulations. The following criteria shall
be used to determine whether a variance shall be
granted:
(1) The conditions upon which the
request for variance is based are

unique to the property because of its
particular physical surroundings, shape
or topographical conditions.
(2) The granting of the variance will
not be detrimental to the public
safety, health or welfare, or injurious
to other property.
(3) The variance will not in any manner
vary the provisions of the Zoning
Ordinance.
SECTION 2. Add Subparagraph (d) to read as follows:
(d) Appeals from a decision of the Board of
Directors regarding a variance request may be
presented to the Pulaski County Chancery Court
within thirty (30) days from the date the decision
is filed in the City Clerk's office.
