155561 ORDINANCE NO. 15,556 4 363 2 3 AN ORDINANCE REGULATING THE KEEPING OF 4 SEES. 5 6 7 SECTION 1. Definitions. For the purposes of this ordinance 8 the following definitions shall apply. 9 (a) "Colony ", the bees in any hive including queens, 10 workers and drones; 11 (b) "Hive ", a frame hive, box hive, barrel, logs, gum skep 12 or any other receptacle or container, natural or artificial, or 13 any part thereof which may be used as a domicile for bees; 14 (c) "Super ", a removable upper story of a beehive. 15 SECTION 2. Regulation. It shall be unlawful for any person 16 to establish or maintain any hive where bee colonies are kept, or 17 keep any bees in or upon any premises within the corporate limits 18 of the City unless the bees are kept in accordance with the 19 following provisions: 20 (a) The keeping of bees for commercial purposes shall be 21 permitted only in areas zoned AF Agriculture and Forestry 22 District. There are no.limitations on the number of hives that may 23 be kept in an AF District. 24 (b) The keeping of bees for hobby purposes shall be 25 restricted to "R -1 ", "R -211, and 11R -3" Single Family District with 26 lots of at least fifty by one hundred (50 x 100) feet dimension. 27 The number of hives and supers shall be limited to two (2) hives 28 per residence and four (4) supers per hive, provided, however, 29 that those residences situated on lots larger than five thousand 30 (5,000) square feet may have one additional hive per additional 31 five thousand square feet of land. 32 (c) Fresh, clean watering facilities for the bees shall be 33 provided on the premises where the hives are located. 34 (d) All hives and supers in which bees are kept shall be 35 located at least twenty -five (25) feet from any dwelling, 36 business, sidewalk, alley or roadway. 0.33 a- z 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 (e) If bees are kept within fifty (50 )feet of any exterior boundary of the property, a barrier that will prevent bees from flying through it, no less than six (6) feet high, shall be installed and maintained along said exterior boundary. Said barrier may be either plant or artificial. (f) The bees and equipment shall be kept in accordance with the provisions of the state statutes regulating beekeeping. (g) Nothing in this section shall be deemed or construed to prohibit the keeping of bees within a school or university building for the purpose of study or observation. SECTION 3. Enforcement. Any person violating any section of this ordinance shall be fined not more than $500, plus costs, for each violation. Each hive in excess of the number permitted in Section 2(b) shall constitute a separate violation. Any person convicted of violating any section of this ordinance shall be also subject to an additional penalty of one hundred dollars ($100) per day for each day he remains out of compliance with the ordinance after the date of conviction. SECTION 4. Public Hazard. Nothing in this ordinance shall be deemed or construed to permit the keeping of any bees which by their actions constitute a public hazard by repeatedly attacking and stinging animals or persons without provocation. In such instances, notice shall be given to the owner of the property where the bees are located of the nature of the attacks. The owner shall abate the hazard within five (5) days or be subject to the penalties set forth in Section 3 above.
