WHEREAS, it has been determined that High Street
betweem Cantrell Road and Riverside Avenue in Block 22 of
Stillman & Buchanan Addition to the City of Little, Rock,
Arkansas, as designated on the plat of said Addition now
appearing of record in Deed Book 10, Page 709, in the Office
of the Recorder of Pulaski County, Arkansas, is no longer
needed for corporate purposes, except for public utility and
drainage easement purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the
City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the
public generally, in and to the street designated as
follows:

SECTION 2. The City specifically retains the right to
use, and allow others to use, the former street right -of -way
in its entirety as a public utility and drainage easement.
SECTION 3. Abutting owners of record, receiving title
to the abandoned right -of -way and easement shall at their
cost remove all vestiges of public use and access as may
exist; such modifications shall include, but are not limited
to the following:
A. The entrances on both ends of the abandoned right -
of -way and easement shall be offset and /or rebuilt
to conform to the standard driveway design as
required by Ordinance No. 12,501.
B. The edge of pavement of the right -of -way shall be
rebuilt to conform to existing conditions in the
general vicinity where the abandoned right -of -way
and easement intersects with the remaining public
right -of -way.

SECTION 4. If for any reason, the sale of the overall
tract in Stillman & Buchanan and Riverside Park Additions,
owned by GFS Limited Partnership, is not closed within seven
(7) days from February 1, 1989, then the closure of High
Street between Cantrell and Riverside Avenue will be
revoked.
SECTION 5. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County and recorded in the records of the County.
SECTION 6. This Ordinance shall take effect and be in
force from and after its passage and approval.

Dear Ms. Czech:
Please be informed that Beach Abstract & Guaranty Company
acted as closing agent and title insurer on the transaction
from Southland Building Products Company to Construction
Developers, Incorporated and as the title insurer on the trans-
action from FGS Limited Partnership to Construction Developers,
Incorporated.
Section 4 of Little Rock City Ordinance 1115,634, which was
passed at a special meeting of the City of Little Rock Board of
Directors on Wednesday, February 1, 1989, states, that,
Section 4. "If for any reason, the sale of the overall
tract in Stillman & Buchanan and Riverside Park Additions,
owned by GFS Limited Partnership, is not closed within
seven (7) days from February 1, 1989, then the closure
of High Street between Cantrell and Riverside Avenue will
be revoked."
Mr. Alden Bowen and I represented Beach Abstract & Guaranty
Company at the closing of the Southland parcel and the FGS
(erroneously referred to in the Ordinance as the GFS) parcel,
both of which occurrred in the offices of The Rose Law Firm on
Thursday, February 2, 1989. Beach Abstract & Guaranty Company
is in possession of both deeds conveying the respective proper-
ties owned by Southland and FGS and the deeds conveying the

closed portions of High Street and Riverside Drive, which was
closed by Little Rock City Ordinance 1115,633 and passed at the
same aforementioned meeting.
By delivery of this letter, we are informing the proper
authorities of the City of Little Rock that the transaction
mentioned in Section 4 of Little Rock City Ordinance
1115,634 has occurred within the specified time frame, and that
Section 4 of Little Rock City Ordinance 1115,634 should be
declared null and void.
Please inform me immediately if further documentation is
needed.
