AN ORDINANCE VACATING AND CLOSING
A PORTION OF SIBLEY HOLE ROAD IN
THE NE 114, SW 1/4, SECTION 33, T -1 -N,
R -13 -W OF THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, it has been determined that Sibley Hole Road
from the fire hydrant to the Fourche Creek Bridge in the NE
1/4, SW 1/4, Section 33, T -1 -N, R -13 -W of the City of Little
Rock, Arkansas (no plat of record on file in the Office of
the Recorder of Pulaski County, Arkansas) is no longer
needed for corporate purposes, except for public utility and
drainage easement purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. Except as stated in Section 2 below, the
City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the
public generally, in and to the street designated as
follows:
Sibley Hole Road in the NE 1/4, SW 1/4, Section 33, T -1 -N,
R -13 -W, City of Little Rock, Pulaski County, Arkansas, more
particularly described as follows: Beginning at a rebar in
the centerline of Sibley Hole Road accepted as the NE corner
of said NE 1/4, SW 1/4, Sec 33, Thence S 03 degrees 47
minutes, 50 seconds W along the east line of said NE 1/4, SW
1/4, and the centerline of Sibley Hole Road 670.32 feet to
an iron pin, thence north 89 degrees 30 minutes 05 seconds W
25.04 feet to the west right of way line of said road,
thence N 03 degrees 47 minutes 50 seconds E along the west
right of way line of said road 671.10 feet to the north line
of said NE 1/4, SW 1/4, thence S 87 degrees 42 minutes 32
seconds E along the north line thereof 25.01 feet to the
point of beginning, containing 0.3849 acres of land, more or
less (approximately 850 feet in length, lying north of the
centerline of Fourche Creek and parallel to 1 -430).
SECTION 2. The City specifically retains the right to
use, and allow others to use, the former street right -of -way
in its entirety as a public utility and drainage easement.
SECTION 3. Abutting owners of record, receiving title
to the abandoned right -of -way and easement shall at their
cost remove all vestiges of public use and access as may
exist; such modifications shall include, but are not limited
to the following:

A. The entrances on both ends of the abandoned right -
of -way and easement shall be offset and /or rebuilt
to conform to the standard driveway design as
required by Ordinance No. 12,501.
B. The edge of pavement of the right -of -way shall be
rebuilt to conform to existing conditions in the
general vicinity where the abandoned right -of -way
and easement intersects with the remaining public
right -of -way.
SECTION 4. This ordinance expressly provides for
rededication of the described right -of -way should the City
of Little Rock, for any reason, decide to reopen Sibley Hole
Road. This provision is added to fulfill a requirement of
the Arkansas Highway and Transportation Department.
SECTION 5. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the Office of the Recorder
of Pulaski County and recorded in the records of the County.
SECTION 6. This Ordinance shall take effect and be in
force from and after its passage and approval.
