AN ORDINANCE VACATING AND CLOSING PORTIONS 4 10
OF WEST 20th STREET WITHIN AND ADJACENT TO
LOTS 1 and 2, PINE HILL SUBDIVISION OF THE
CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, the Board of Directors of the City of Little Rock,
Arkansas, has determined that portions of certain streets and
public rights -of -ways situated adjacent to Lots 1 and 2, Pine
Hill Subdivision of the City of Little Rock, Arkansas, as desig-
nated on the plat of said Addition now appearing of record in
Deed Book 292, page 319 and on the replat of said Lots 1 and 2
now appearing of record in Plat Book 4, page 347, in the office
of the Recorder of Pulaski County, Arkansas, have not been used by
the public for a period of seven years, and are no longer necessary
for the purposes for which they were originally platted, dedicated,
or devoted, except for utility and drainage easement purposes, and
therefore desires to vacate, close and abandon all of its rights,
title and interest therein, together with that of the general
public, pursuant to the power granted cities of the first class by
Section 19 -2304, Arkansas Statutes 1947, annotated.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION I. Pursuant to authority of Section 19 -2304, Arkansas
Statutes 1947, annotated, except as stated in Section 2, below,
the City of Little Rock, Arkansas, hereby releases, vacates and
abandons all of its rights, together with the rights of the
public generally, in and to the streets and rights -of -ways
designated as follows:
The 25 -foot wide right -of -way of West 20th Street from the
west right -of -way line of Gilman Street (closed) to the
east right -of -way line of Potter Street (closed)
SECTION 2. The City specifically retains the right to use,
and allow others to use, the former street right -of -way in its
entirety as a public utility and drainage easement.
SECTION 3. Abutting owners of record, receiving title to
the abandoned right -of -way and easement shall at their expense
remove all vestiges of public use and access as may exist; such
modifications shall include, but are not limited to the following:
A. The entrance on both ends of the abandoned right -of -way
and easement shall be offset and /or rebuilt to conform
to the standard driveway design as required by Ordinance
No. 12,501.
B. The edge of pavement shall be rebuilt to conform to the
existing conditions in the general vicinity where the
abandoned right -of -way and easement intersects with the
remaining public right -of -way.
SECTION 4. A copy of this ordinance, duly certified by the
City Clerk, shall be filed in the office of the Recorder of
Pulaski County, Arkansas, and recorded in the records of the
County.
SECTION 5. This ordinance shall take effect and be in force
from and after its passage and approval.
