14701r i= M M M M M= M M = � M= N 0 ORDINANCE NO. 14,701 AN ORDINANCE TO EMPOWER THE CITY MANAGER OR THE CITY MANAGER'S DESIGNEE TO APPOINT AND AUTHORIZE INSPECTORS AND CODE ENFORCEMENT OFFICERS TO ISSUE CITATIONS TO ALLEGED VIOLATORS OF CITY ORDINANCES OR REGULATIONS OR THE FIRE PREVENTION CODE; DECLARING AN EMERGENCY. WHEREAS, Act 763 of 1983, codified as Ark. Stat. Ann. ss42 -1009 (Cum. Supp. 1983), specifically provides that City employees who are charged with the duty of enforcing a particular ordinance or regulation may be authorized to issue citations for violations of that ordinance or regulation; and WHEREAS, Code Enforcement Officers, Fire Inspectors and Public Works Inspectors regularly inspect property and premises within the City of Little Rock to determine if violations of City ordinances, regulations, or the fire code exists; and WHEREAS, there exists a great danger to the public if individuals within the City of Little Rock are allowed to continue to violate the various ordinances, codes, or regulations; and WHEREAS, the Little Rock Police Department does not have sufficient personnel to enforce all these various laws. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Manager or her designated representative is hereby empowered and authorized to issue citations to require alleged violators of the Little Rock Municipal Code to appear in the Little Rock Municipal Court to answer charges of those violations. The City Manager shall designate in writing the individuals who are authorized to issue citations. This list shall be filed with the City Clerk. SECTION 2. It has been found and declared that there is a great confusion concerning the authority of City Inspectors, Little Rock Fire Inspectors, and Code Enforcement Officers to issue citations in connection with their enforcement duties which has the result that the public peace, health and safety is often 261 no - z - seriously jeopardized; and that this measure is required to provide a remedy therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety, shall take effect and be in full force from the date of its passage and approval.
