14767M M M M M w M M ORDINANCE NO. 14,767 1�1 AN ORDINANCE AMENDING IN PART SECTIONS 1 AND 2 OF ORDINANCE NO. 11,366 TO PROVIDE FOR LEVYING ADDITIONAL PRIVILEGE FEE TO BE PAID BY ARKANSAS LOUISIANA GAS COMPANY FOR THE YEAR 1985; PROVIDING FOR THE PAYMENT THEREOF. WHEREAS, the Arkansas Louisiana Gas Company (hereinafter sometimes referred to as "Gas Company ") is or will be duly authorized by franchise ordinance to operate a gas distribution system and appurtenances thereto, used in or incident to the rendition of gas service to Little Rock, Arkansas and the inhabitants thereof residing in said municipality; and WHEREAS, the Gas Company is now or will be occupying the streets and alleys of this City for the purpose of operating, maintaining and extending its gas service to the municipality and supplying the municipality and consumers therein gas service; and WHEREAS, the municipality is entitled to receive such just and reasonable fees from the Gas Company which the municipality may lawfully impose and the Gas Company is entitled to pay. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the sale, furnishing, transmission and distribution of gas and energy by the ARKLA Gas Company in the City is hereby declared to be a special privilege; and that the use of City owned lands and properties is a special privilege, and that for the latter privilege the Gas Company shall pay to the City a special fee, charge or imposition, as follows: For the year 1985, the Gas Company shall pay in equal monthly installments beginning January 1985, the sum of Two Million, Nine Hundred Ninety -five Thousand Dollars ($2,995,000.00) or an amount equal to five and two - tenths percent (5.28) of the Gas Company's gross revenues as paid to it during the calendar year 1985 by industrial, residential and commerical customers located within the corporate limits of the City of Little Rock, whichever is greater. 134 D- P 4-10 135 Section 2. Payments to the City by Arkansas Louisiana Gas Company for the net additional fees as provided for in Section 1 hereof shall be monthly payable by the 15th of each month. Section 3. All ordinances and parts of ordinances that conflict herewith are hereby repealed. Provided, however, Ordinance 11,366 of the City of Little Rock is repealed only to the extent that the same is in direct conflict herewith and nothing herein shall be construed to alter or change the terms or conditions of the present franchise under which the Gas Company is operating.
